I have searched these forums and can't find anything specific to my issue. It seems Erudio passed my debt on to Capquest. I have a Student loan between 1997 & 2000 which I deferred until around 2003. I sent Capquest a Statute Barred letter and they replied saying it's not statute barred as it only defaulted in 2017 I am presuming by Erudio. I don't really know who to proceed from here as National Debt Helpline couldn't really help and advised I would need legal advice. I assumed the 'cause of action' would be 12 months after my missed deferment.
I have not made contact since that last deferment in 2003. I have moved around quite a bit within the UK.0 -
Hi, sorry again to post on a thread focussed on Erudio. I have explained why before, so won't repeat myself.Since my posts on this forum in May I have received my earlier statements. They show that SLC did indeed make an unauthorised debit from my account back in 1999. Just the one debit, and not as much as my vague recollection was telling me, but that's beside the point - I was way below the repayment threshhold, the money should never have been taken in the frst place, and it certainly should have been refunded to me. As explained earlier, I was effectively persuaded by an SLC 'advisor' to consider it as a voluntary part-repayment to reduce the overall debt. I was a chump, and didn't insist on reimbursement.Obviously, I will be demanding that Thesis/SLC repay me the original amount plus interest. Can anyone suggest a reasonable amount to ask for compensation? Also, what body or organisation do I approach if I am not satisfied with Thesis/SLC's response?Many thanks.[EDIT] Spoke to Thesis after posting the above. According to them my loan matures this October.[EDIT 21/07] Sorry, it was a bit daft of me to ask how much compensation it would be reasonable to expect when I haven't given an indication of how much was taken from my account (less than £100). Also, I phoned the FOS who said that they might be able to help if I'm dissatisfied with Thesis/SLC's response (now that the loans are owned by private sector firms, not the government). I've now sent my formal complaint to Thesis, so I'll update on the situation when I get a response (if anyone's interested).0

Lungboy said:Yeah, your loans didn't start to accrue interest until you received your final installment of your final loan, so all write-offs are based on the date of your final loan. That's the same as if SLC were in charge.
My very first account statement shows interest starting to accrue a month after the first instalment of my first loan! This was in 1994.

I don't know if anyone can help I've been arguing with Erudio about this for years, I had another Drydensfairfax letter about my student loan from my old style loan that ended in 1998
I sent my bank statements as proof of my income to defer my loan in 2015 (self employed). I then received a letter saying my application was incomplete, I rang them and was told that I needed to supply my Tax Return or Accountants Letter (I didn't have these at the time) and that they would not accept my bank statement as proof of income for my second deferment - only a tax return or accountants letter. I supplied bank statements and invoices the year before though and it was accepted then.
However I received a message from Erudio in 2019 suggesting I should have sent business invoices as well as my bank statement. This information was not relayed to me during my phone call in 2015. I can't remember if I sent the invoices as well at the time as it was so long ago, but I do remember printing them so either they lost them or I didn't send them.
Erudio have stated they do not have a physical recording of this call or record of giving me the wrong information however they have sent me their own call logs which do state clearly that they told me on the phone in 2015 that ‘however this year we are asking for a tax return’ . This contradicts all correspondance from them that says I could have provided bank statements and invoices. I feel the person on the phone call misinformed or was trained poorly to advise me what was missing from the loan deferment.
It's not a massive amount but I don't see why I should be on the hook when they share, at least, part of the blame for this error.
I'm speaking to a solicitor about it as well

I was wondering if anyone has had the same issue as me. I got my first student loan in 1994 but at the end of the academic year I left uni. I then attended a different university and got a student loan in 1996 then another in 1997. I have never earned past the threshold so have always deferred. My question is this; Because I left uni in 1994 and did not have a student loan in 1995 does this gap and different uni mean that it is not ‘linked’ to the other 2, therefore it should have been written off by now? I am in the same boat. They didnt accept my bank statements as adequate proof because i had only been self employed for less than a year and had no tax returns to supply. Before that i was on maternity leave.
Still arguing with them about it several yerars later.
Now its been 25 years and im over the age threshold too, but due to them not accepting deferral proof i now have arrears, which barrs me from exiting the loan agreement.
Im still earning far less than the threshold amount.

I submitted deferment early August online, I attached copies of wages slips however they wrote to me asking for proof, they have said no attachment. I posted photocopy of wages and also child benefit award letter around 12th Aug. I phone up on the 21st to confirm if they had received them which they confirmed they had and said they will be checked soon and I would receive a letter about the deferment. Today I received a letter saying they were still waiting for this evidence so I called them today, guy on the phone confirmed they had them as said he would review them now, unfortunately as of the 1st September the income threshold has dropped and I'm now slightly over. I said that this was unfair as I had sent in all documents before and you confirmed you had received them and therefore the threshold from September 2020 should be used to assess my deferment. I've put in a complaint and now have to wait 3 days for response. Also I'm considering putting child benefit claim into husbands name as this will also take me under new threshold. Has anyone had similar experience and also made complaint through FOS?

I wouldn't think twice about putting CB through your husbands name and then you don't need to declare it.0
