    I think we need to identify if there is a problem before the proving stage. I am just throwing the idea out, whilst admittedly not knowing much about this rather mysterious area of data usage and regulation around it. But its great to have more info/input.

    To start with though, we are not debtors. Deferrals is something very specific and we have fully complied with the T&Cs of our loans. Being on Arrow's books, they will more than likely just dump our data on its database, a database where companies access it for a fee. I think we agreed on our original loans to our data being handed on to relevant third parties when deemed necessary. But we gave our data to the government in confidence, not a private company who imposed themselves on us. We had no idea our data would be sold (it is our data that was sold otherwise erudio wouldnt know who we are). Little did we know we would be agreeing to that data, bank info etc, being given to a huge debt collector. They initially tried to mark our credit files with language more fitting to people breaking their contract or negative wording. Not that they went through with it, i dont think anyway, but it kicked up a storm when they were trying to figure out their process and what they would do.
    If they can monetise our data, especially with something like the PCB where the real details are virtually hidden, i think it is safe to assume the door has been opened for more Arrow trickery. I agree evidence is needed. I am just putting out what i think out there, it is for everyone to decide if its an issue, bullsh*t or something in need of more info.

    As we gave this info to the Gov, i think it is something in need of an answer. Two things for sure, this database exists and includes data from people on Arrow's books, which includes us. Our contracts have on it that data can be shared with third parties...experian is a third party. Who else would Arrow deem a third party? Would Arrow miss a chance to add a quarter of a million names and many more data points numerically to this PCB to make it more valuable. My experience of them so far says no. Dont trust them one inch, and if they can get away with something, they will try.

    I would also add that Erudio's 1st DAF had some rather interesting questions about home ownership, perfect for such a database where a lender can see someone's potential collateral if they miss a payment. I initially thought it was for Arrow to see what they could get hold of, now i am not so sure. They also have IP address and other info from its portal and probably emails. This is valuable info to a debt collector, the kind someone would be willing to pay to access in certain situations.
    I would like to know one way or the other but i know it is not that big a concern for most.

  • It is a great concern. I follow your reasoning and I am not happy if this is taking place. I think you are most likely right but nothing can be done if it is happening in secret. The question is how can it be confirmed? Can MSE or anyone else get Arrow to admit to it with a direct question?

    Has anyone tried complaining about it to Arrow? Or asking for a copy of their data from the PCB?

    They must respond to such a request. An affirmative confirmation from them would settle it but if they deny it would you believe them?

    Personally, I have been surprised at how little interest MSE seems to have taken in the (I am going to keep it very polite here) missteps these debt collectors have taken whilst dealing with these student loans. Maybe that has something to do with Martin no longer owning the site?

    So following in the shoes of so many my Drydens PAP letter arrived today.

    So did a letter from Erudio saying my account had been transferred...

    I know I have to reply before the 30 days is up (28 days given they aren't very fast at posting letters)

    I tried to defer but Erudio ignored me, I sent in my letter twice, and a follow up to ask why they were ignoring me.

    Solicitor thought at time that they were in breach of contract.

    So can I just send back the reply form and tick box D, do I really need to set out why I dispute it?

    I assume I can bin the income and expenditure forms?

    I'd advise spelling out in great detail why you've ticked box D. If it goes to court you don't want a judge to decide you've not been willing to engage. No idea on the second question but I'd guess if you're disputing you don't need to fill it out yet.
