    I complained to FOS after Erudio sent a Notice of Default when the Ombudsman said instead I should get another chance to sign the DAF. And in fairness to FOS, they upheld my complaint straight away.

    Erudio sent a letter not long after I complained to FOS informing me the Notice of Default was legally defective as it contained the wrong amount of arrears. It makes me wonder what is going on as arrears should be calculated automatically. Is there something systematically wrong with their calculations?

    I know it's not necessarily your personal situation, but for those who are private renting could Erudio marking credit files potentially cause housing problems? If someone refuses to sign Erudio's (extra/new terms and conditions) DAF and consequently Erudio marks their files as being in "arrears".

    Haven't been here for a while. Haven't had the time or mental energy to think about Erudio!

    I've only had a chance to skim the last few posts (may try to catch-up over the weekend) but suffice to say I'm already feeling sick about when I next have to defer because I definitely don't want to sign a un-modified DAF.

    Btw, I haven't received any statements for over a year.

    ETA. Want to add how grateful I am for those of you here who are keeping up the fight. It's so good to know there are others out there dealing with Erudio - and not giving in.

    Landlords, letting agents and the tenant credit checking services they use cannot see credit account level data. They just see public record data such as CCJs/bankruptcies, and a few other items like linked addresses. Any 'report' or 'score' they can get does not show arrears or defaults on credit accounts.

    So no, Erudio marking arrears or a default should not affect private renting.

    Thanks, Fermi. I was wondering about that.

    Still the nightmare of Erudio continues however. I don't want Erudio to put me in "arrears" or "default" but I don't want to sign their DAF. I don't know what I'm going to when it comes to my next deferral (not due yet). I'm hoping things might have changed for the better by then - but somehow I'm not feeling too confident about that.

    Has anyone actually had a credit check performed as part of deferment? They certainly haven't done so with mine when I checked Noddle/Clearscore (Callcredit/Equifax).

    It's also now around 8 weeks until most have their deferral deadline. If you have not yet received your DAF, I would certainly suggest emailing in a complaint, bearing in mind the declaration from Capquest's Mr Gary Burns, posted by Anna, that they would be complying with the Regulations this year and issuing all forms 8 weeks before the deadline. If you are not satisfied with the response, I would recommend a complaint be sent to the Financial Ombudsman Service seeking redress.

    Its less than 7 weeks now. They are trying the same trick as last year. I would add requesting compensation as well for having had to contact them.and spend time messing around.That would probably be more relevant if phoning them but emailing them still takes time you shouldnt need to be spending. They should be mailed out and arrived 8 weeks before the deadline without you needing to do anything. Making an official complaint is the only way this will stop!

    That is very worrying. Seems changing over to Capquest as the frontline service provider hasnt ironed out the problems after all, they seem to be using it to push the envelope even further. We really do have to lodge official complaints and shout loud about it again i think. The new deferment year brings around new tactics, the old ones they like and maybe even more to come.
    Ive twaated Martin Lewis about it and a few others. I think we will be seeing quite a few more of that problem. Here is the post for speeds sake:

    Can anyone advise me on how to handle this problem?

    I've recently received a letter of arrears from Erudio student loans going back two years. I've queried this with them as I have successfully defered every year and have received letters to that effect from them. I made the points.

    1) Erudio have sent me letters saying my loan was defered
    2) If it wasn't defered why was the money not collected at the time as there is a direct debit set up

    They told me they have a new computer system in place which has highlighted arrears in many accounts and that they actually had in one instance taken money out of my account. This strikes me as unfair as they are trying to change the terms of the loan agreement after the fact and shouldn't be asking anything from me nor taking anything out of my account.
