    Currently waiting on deferment acknowledgement. They have acknowledge receipt finally of my proof of income and said they were processing the claim. I know I earn less than the £28K threshold and have proved this. I will just keep applying with proof of income and refuse to make payments until they accept my proof. ( last year I had to apply twice in order for them to finally accept).
    Paid off the last of my unsecured debts in 2016. Then saved up and bought a property. Current aim is to pay off my mortgage as early as possible. Currently over paying every month. Mortgage due to be paid off in 2036 hoping to get it paid off much earlier. Set up my own bespoke spreadsheet to manage my money.
  • I have already tried both CAB and then FOS to no avail! Feel like I've been tied up in knots by them and last time I spoke to them they are not budging on their position. Without clear legislative proof I don't think I'm going to win this one.

    The FOS are never going to accept that Erudio's new forms are unacceptable and are not actually legally required to defer. The FOS simply can't afford to pee off their paymasters that much, so will take a politically based stance to deny any form of problem.

    If you read back in the thread you'll see that the only success is/was/reportedly when use or threat of legal action against Erudio was used.

    I've been in touch with Erudio about the fact they're refusing applications due to amended DAFs (some used my amended DAF, which was accepted when I applied). It's been reported on here that Erudio are saying any application made with an amended DAF shouldn't have been accepted, it was an error so the deferment doesn't stand - I made it clear about all of the changes I made to the DAF. They replied yesterday with this:
    I can confirm that your current and previous year’s deferment remains fully valid and the repayments are deferred until 9 June 2016

    There was some waffling before and after that quote, but no explanation as to why an amended DAF is ok for some but not others. I at least have a name, so I'll ask him to explain himself.

    Happy new year everyone, let's make this the year we make Erudio back down and know their place as administrator of our loans. That's all they are, there's nothing in our terms that says we must sign up to their !!!!!.

    Section 10 of DPA, or unfair relationship under CCA, or plain old breach of contract, take your pick! :)
  • @tashg - Just because the FOS say it is so it does not make it right. ESL may not want to budge from their position and indeed they won't unless the threat of court action is made. Even then, to date there are no court rulings against them because they back down at the last moment and defer because they cannot risk a single ruling going against them. It would bring down their scam and cost them a fortune.

    @Anna2007 - cheers Anna, shows how ESL like to treat us all the same!

    Has anyone had a 'soft search' carried out by ESL/Arrow and considered using it as a basis for legal action to test the DPA principle?

    Some background. - From 2006 onwards, I had many personal problems which resulted in bankruptcy in 2008 (which didn't include student loans). In the following years till 2014, there was 3 different work and/or life threatening diagnosis, 2 significant family deaths, which all resulted in some metal-health issues within the family. As these issues have now been dealt with, I realised in 2014 that I needed to get on top of all the other issues which had been stupidly ignored!

    I had had many problems with deferments the old Student Loans Company as I've never earned (self-employed) over the repayment threshold, but had intermittent success in SLC accepting deferment, as they kept loosing communications, proof of income and deferment forms. Despite constant arguments with them over deferment, due to the other stuff in life, I was not proactive and unfortunately SLC registered my loan in default in 2011. Somehow, I did not know about this until early 2015!

    This was particularly bad as I gave up arguing with them as I was approaching 50 years old in 2013, and believed the loan would be written off. However, I did not know SLC had registered the loan as a default, so it was NOT written off!

    Erudio - Again out of ignorance on my part, when Erudio starting contacting me I thought they were a company fishing for repayments on a loan I believed had been written off in 2013 (when I was 50). In May 2015 I prolapsed two discs and was unable to work for a second time in 4 years. Over the summer I was able to circumnavigate the mountains of paperwork from both SLC and ESL.

    I'm not sure I have energy to fight SLC that my loans should have been in constant deferment and therefore paid off in 2013 and not sold to ESL in 2014.

    I now have to deal with Erudio. I have not been in deferment as I didn't believe I had to pay them anything anyway. I've made occasional payments including £100 last month to keep them from putting the loan with them into default.

    Erudio are now claiming that the loan 'matured?' last March, despite no communication from them to that effect! Erudio now say that I've lost the right to repayments, but have to pay the whole outstanding amount (just under £5k).

    I explained in December that due my health, I had only just returned to very limited part-time self employed work. This tax year 15/16 I will only break even beginning of March, so my profit will be a thousand at best!

    I need to speak with them again today and over the last 2 months I've been searching this thread when I can, but I can't find what I'm looking for in my more unusual situation.

    I shouldn't need to pay this at all, but I'm not sure I have the time or energy to fight this (unless someone has good info on how to fight it), and I'm wondering if I might be forced to either repay the amount in full, or take out a new loan agreement with Erudio? I can't find anything that says what a new agreement might be, as people seem to just be saying DON'T. I wonder with any new contract, about how long the term might be and about whether I'll still be able to defer. I'm coming up to 53 and I think it's pretty unlikely that I will ever earn over the threshold.

    Does anyone have any experience or info on this? Tia
