It's shocking what the Government can sneak through via a Statutory Instrument, I had no idea until the Tax Credits cuts fiasco. There's no debate, discussion or agreement involving your elected MP, only the House of Lords (who'd have thought?!) to rein them in when the other house gets too big for its boots.
If any exemption can carry forward, I can't quite believe that it would apply to the likes of Arrow Global and Erudio in the same way as the SLC, could they really be seen as equivalent in legal terms? The original contract was with the Government vs a profiteering private company... not exactly what we signed up to.0 -

Anyone had their credit file marked yet? We were told this would happen by the end of the year and look... here we are, last day of 2015. Come on ESL! Why are you not exercising the rights you say you have to mark our credit files? Don't you need to mark our files to run your deferment process correctly?

Can't imagine a respectable and honest company such as Erudio/Arrow would knowingly make idle threats against ex-students who never imagined their loans would be in the hands of debt collectors.

Hi,
I have a very old load held by Erudio, which has been in deferment for some time. Deferment will end in June, and I will be earning over the threshold at that time. However, my job will finish in August, and I will probably be leaving the country for a while, not employed. It seems to me, that if I fill out the form, they will start taking money from me in June, and also, July August, but I will not be working in September,Oct, Nov etc and they will still be taking money from me, which I will be unable to afford? Any advice greatly appreciated.0 -

Can you please tell me if the old deferment application form was legally acceptable?
I refused to complete it when first sent it, although I did send them a letter that I'd got from an internet sight called 'no to erudio', which stated that although unwilling to complete the form I confirmed and evidence I was entitled to defer.
I was in debate with Erudio about this for a year and a half before I realised they had a new form and sent them this along with proof of earnings. They have replied that they will only backdate my deferment by 3 months and that I owe them over £400!0 -
In my view they should have given you deferment in the first place with your letter and evidence although they will not defer without the threat of court action. There is NO requirement as far as the regulations are concerned to use any 'DAF' and the reason Erudio want you to use one (either their first or second set of forms) is because they want to gain your consent to change original terms and conditions (i.e. report your loans to CRAs and contact third parties to snoop on your business).
Its a shame if you have used their second style of form because it is no better than the first. There is nothing to stop them from backdating your deferment and wiping all arrears. Just they need to be forced to do so either by an ombudsman (FOS) or court. They are only interested in your money and their profits.

Still thinking about this one because it appears you are between a rock and hard place. In theory you should just be able to pay up for the months you are earning and then bang in your deferment and have it granted in a couple of weeks. With Erudio though I wouldn't trust them an inch. I've been phoning up every month and paying them as I can't get deferred as I'm over the threshold.
I phoned up this morning to make a payment and discovered that the process is slightly different in that the options when you first phone have changed. When I mentioned this to the agent, he said that operations have now been taken "in house" and people will be speaking to a Glasgow office from now on.
Still waiting for a response to my second settlement offer which they've unsurprisingly done nothing with. My phone number which had previously been on file suddenly wasn't and my record shows they are still dealing with a complaint that was resolved ages ago. Seems they've made even more mistakes.0 -
