That is basically blackmail!
The contract is an unfair contract with Erudio deciding on who gets deferred or not. Does anyone know contract law? Could this be the case? It is to Eudio's benefit to lose forms etc.
Stand firm people, cancel those DDs on mass and tell them to jog on as under the threshold for repayment!0 -

Have I mis-understood what I've read on this forum? I was under the impression that Erudio could not insist on us using (and therefore signing) their own form? Someone had posted a template deferment letter to use instead (either on here or mumsnet - sorry, I can't recall offhand where). And it was pointed out that there had never been any obligation to use SLC's own deferment form. As long as we provided all the required information.
Also, can someone confirm that if a deferral hasn't been accepted in time - because of Erudio's delays, the borrower does not have to make repayments? Surely if someone returns all the required information in good time (proved by recorded delivery), any delays due to Erudio's incompetence and/or inability to cope, are not the fault of the borrower - and therefore no requirement to repay (or risk default) can be enforced?
My deferment isn't up for renewal until September. Barring a large and unexpected payrise, I'll remain eligible for deferral. I'm planning to send my deferment application weeks in advance. By recorded delivery. And I have no intention of setting-up a direct debit, and will fight any attempt by Erudio to claim I owe payments if they don't defer me in time.0 -
Well I would advocate the cancel DD, send them 3 payslips with your own letter by recorded delivery approach and then ignore them for a year.
Let them go to court if they want the money!0 -

Well I've sent my stuff in via Special Delivery to ensure I have a record of it's arrival. Now it's a waiting game to see if they try and d**k me over.0

Mail her and explain those things to her Jelaw! This is our chance to tell people who can investigate and take the story to the wider world. We dont know when this story will run dry, and in my experience it can be very quickly, so if we dont continue to reach out now, everything thus far will be for not much because not much has changed yet, and we will be condemned to these practices for the next 10 years. Not to mention all future student...0 -
Anyone affected by Erudio might want to consider using the Data Protection Act 1998 (DPA) for cases where there has been mishandling of data (which appears to be the case from comments in the MSE blog). DPA provides individuals in the UK with
- a right to object to data processing that is likely to cause or is causing damage or distress
- a right to object to decisions being taken by automated means
- a right in certain circumstances to have inaccurate personal data rectified, blocked, erased or destroyed
- a right to claim compensation for damages caused by a breach of the Act
Although the only way to enforce these is through the courts, it would be worthwhile complaining to Erudio (addressing it to the Data Controller at Erudio) and escalating matters to the Financial Ombudsman and the Information Commissioner’s Office (ICO) if their response is inadequate.
The ICO has a good guide (Google search: The Guide to Data Protection) for interpreting the requirements of DPA on its website. I would suggest looking at the guide to see whether Erudio’s conduct has met with the baseline requirement outlined in the DPA.
