I asked BIS about the difference in the wording from "satisfy" to "show" and unfortunately it was unable to respond as Parliament has now been dissolved.
I also asked SLC and it said it can't comment as it is an issue for BIS.
I've just received the following response from Erudio regarding the wording on the 1997 regs ("satisfy") and the 1998 regs ("show") in relation to the DAF...
“Erudio is aware the wording changed from “satisfies” to “show”, and some customers have taken this to mean they do not need to complete or sign the Deferment Application Form. However, while the wording has changed, the intention of the sentence has not. When dealing with so many customers, it is reasonable to have a process in place requiring the completion and signature of a DAF form to ensure Erudio treats all customers equally and manages the large volume of deferral requests it receives efficiently.”
Many thanks, MSE Paloma
When did Erudio become aware? They sent me a letter in Feb 15 quoting 97 regulations at length. Did they have some sort or awakening last week or are they just being untruthful and trying on a DCA con-trick?
I asked them to define the legislation that says I must use a DAF. That was one of the simple questions I asked them. They quote revoked legislation. So where does that leave me now? :rotfl:
It is very reasonable for us to have a simple DAF we can use that does not alter terms or conditions or while we are at it, makes threats and hides things on the ESL website. While Erudio continue to treat 'customers' like this, it is more than reasonable for us to legally defer without using any DAF!Paying for uni to get a job... just to get a job to pay for uni0 -
This from the Mumsnet Erudio thread - about Erudio possibly not signing for Royal Mail letters - is this likely?
Would be great if people could post on thread about any Deferment delivery issues - it could all be part of Erudio's design to push people past their deferment dates.

*I sent the form, and evidence, by signed for 1st class on Tuesday.
The online tracking still says it is in the system, and the last update was received at POL (local post office).*
How weird!!! I sent my form too by 'signed for first class' - £1.73 - should arrive next working day (not guaranteed) and with a scan of the signature online - this worked fine last year.
However posted mine on Tuesday - should have been with Erudio on Wednesday but when I check online Royal Mail say it is still in system - last update received at POL.
I was going to post about this anyway and then saw your post and thought I wonder if Erudio are not bothering to 'sign for' on the Royal Mail PDA devices that postmen carry.
This would mean of course that Royal Mail are stiffing their customers by allowing Erudio to take the mail without signing for each individual letter - but it did occur to me that if Erudio get say at least 500 pieces of mail per day - each one requiring an individual signature - they may have come to some 'arrangement' with Royal Mail.
Seems possible but very wrong as Royal Mail would not be fulfilling their obligations to us by not obtaining the signature at the point of delivery.
Anybody know a postman who might know if Royal Mail do bulk arrangements for businesses like this?
Has this happened to anyone else?
Anyone get signature proof?0 -

I sent Erudio yet another letter on Wed, signed for 2nd class & surprisingly it was signed as received on Thur morning by the same person who has signed for all the letters I've sent them (what a boring job this person has). Some of my signed for letters have taken much longer to appear as received on the Royal Mail website that I'd have expected, & the last 2 2nd class have got there quicker than than most of the 1st class. I've been told by post office staff that sometimes the track & trace system isn't always an accurate reflection of where letters are in the postal chain. Why not, I have no idea, & neither did they, but they said it was something that they had plenty of questions about.
I was told by someone who used to work for Tax Credits helpline that there was no point in sending any paperwork to them using signed for, as they were still signed for in bulk since they got so many letters. She suggested to get proof of posting only. Not sure if Erudio are getting quite as much post as TC yet.And I find that looking back at you gives a better view, a better view...0 -
Bulk 'signed for' deliveries are scanned to an individual PDA and signed for as a batch. It is, therefore, possible to confirm that a individual item was delivered as part of the batch.0

thanks @ Jonez and gardenia101 - it's good to get an insight.
It's easy to get very paranoid.
Although, of course, that doesn't mean they're not out to get me!0 -
A week or so ago @erudioed suggested printing off a DAF from one dropboxed by Anna. I initially said I probably wouldn't do that, as I had doubts they'd accept it, but last week, I did, as I grew tired of waiting for a deferment pack. I filled it out but scribbled over bits I don't agree with. I sent it with pay slips. As luck would have it, the DAF pack arrived the day after last week.
I have since had acknowledgement they have received a form and wage evidence, but can't yet say if they can defer my loan with this documentation. I'll give it a few days and wait with baited breath.0 -
I think they will find it very hard to refuse on those grounds. After all, it is their delayed send out that has led many of us to use this, and it isnt like we have refused to use a DAF, we took the only option we had to get things back in a timely manner.0

Has anyone with split loans had any contact from erudio for this years deferral? I had my daf from slc late feb as normal and have phoned them to confirm my deferment was accepted. But I have have had nothing from erudio or honors. not even a reminder that my deferment runs out on April 10th.0

I thought that if you have split loans you have to deal only with SLC - maybe that's why the others haven't contacted you?0
