ERUDIO student loans help

I've spoken to erudio who have confirmed that they have my old address, do not have my parents details which were on the original loan paperwork, so I question if they even have that paperwork. They have admitted they have not made contact for over 8 months and that when I phoned in the summer there were no a alerts or notes on the system for me or requests to obtain bank or update details. It even stated that I was advised to try honour student loans as it wasn't them that called. Interestingly during this 30min conversation they tried there damned hardest to get me to update info, even offered to raise a complainant to try to get my details, obviously I declined there offer. Oh I also asked them to screen dump my notes and email them to me which apparently would cost me £10 which I must send by check. I declined. I shall be forwarding my case to the ombudsman tomorrow.0 -
Well the ombudsman hasn't got back to me. Somehow I'm going to have to scrape the money to pay them. I'm angry they are using money that is not for me but for my kids so I can work. My ex has now withdrawn the kids maintainance. The fact if I had a partner I would be able to defer. Why are you paying them?
They have no right to grant deferment or not.
You have "showed" you are under the threshold therefor you are deferred.
It is in the terms and conditions.
If you give them any money they have conned you, don't be a fool.0 -

So did SLC let you defer when the Child Tax Credits took you over the threshold? As they didn't let me, it seems like they have made an error on my account also then. For 3 years I've had this problem, and it is only now that my little one is in school that my earnings look as though they are less (due to no tax credits)
I'd be really interested, as it seems as though SLC were making it up as they went along, and as a result making it harder for me when my account eventually went over to Erudio.
If my application should have been granted deferment a few years back, my account wouldn't be in arrears now.

It also doesn't matter what the SLC included or not, the terms and conditions are what matter.
Gross income is nontaxable income always has been always will be.
I don't see how Erudio can make their claims to include non taxable income stand up in court.

Nope. Gross income is income from all non exempt sources before deduction of tax on the taxable ones. Both taxed and untaxed sources included.
"Gross" doesnt mean just "taxable" ones.
I can see why people are keen to believe otherwise, but you are just setting yourselves up to look more than a bit foolish when your argument falls flat on its backside.
Plus Erudio will be rubbing their hands about all the arrears that build up for people who are taken in by that nonsense.Still rolling rolling rolling......<

Where is this in the terms and conditions?
Non exempt sources? Where is this written down? On the SLC deferment form? That doesn't mean it is right. The terms and conditions are what are important.
The SLC probably made a mistake to include these things in gross income.
We only have what the SLC decided to do to go.
If you read the terms and conditions it just says "gross income"
It all comes down to interpretation.
Now the standard definition of gross income is Non taxable income.
Erudio are claiming self employed people's gross income is turnover! That sounds like your definition of gross income!0 -
Any perceived standard definition of gross income used elsewhere is utterly irrelevant if an act or regulation of parliament specifies its own. As the 1990-98 student loan regulations do. That includes income from all sources except the exempt disability related benefits.
You can bluster all you like. That is fact.
I'm no fan of Erudio an their definitions. I prefer the correct legal ones which is what I'm doing here.Still rolling rolling rolling......<

Ok, so turns out there will be no deferment for me. Child Benefit takes me over the threshold. Damn!
I'm just going to have to increase my hours at work then. More work and stress, but then at least this whole Erudio fight will be over. I'll just pay them and not have to speak to them again0 -
It's weird though, as if I was not a single parent, I would not have this situation, my household income would have been more....but I would have been able to defer...go figure0
