Just had my for complaint decision. The adjudicator is a nupty. She hasn't even acknowledged that they miscalculated my pay adding my childcare vouchers onto my pay. I don't earn that money I pay it out. I appreciate but they should have used my gross earnings. I'm fuming. I'm earning less than 17k and they have added my maintainance as well as my benefits ( that's Normal) meaning I noe have to pay. My maintainance isn't mine it's my kids. I'm sat here crying. My mp npw has a copy and I have complained she hasn't looked at the issue of the miscalculation.

You dont have to accept the adjudicators decision. Complain to the FOS and insist that it goers to the next stage and is looked at by an actual ombudsman.

    http://www.financial-ombudsman.org.uk/publications/technical_notes/QG7.pdf

what if we don’t agree with the adjudicator’s view?
In most cases, both the consumer and the
business accept the adjudicator’s findings and
the complaint is then settled. If you disagree
with the view we have put forward, you should
talk first with the adjudicator working on the
case. If matters remain unresolved, either
side may ask for a final decision by an
ombudsman. This only happens in about one
    in ten cases.

I have done rizla. I have a feeling I'm going to have to pay this. Which will seriously hit my already stretched budget. If I had a partner living with me there would have been no questions about deferment. But I havnt and I am on benefits to help me pay my childcare so I can work.

No. You said an adjudicator had decided. Appeal and take it to an actual ombudsman. An adjudicator is NOT an ombudsman.

I have requested she pass it to an onbadsman and told her I'm not happy. By return email. If erudio can't do basic maths they shouldn't be in business.

  • Yep. That sounds about right. I remember Arrow invested the smaller amount and CarVal the lion's share. So nothing untoward there.
But it's a bit worrying that the 300,000 outstanding loans are 'targeted', when a percentage are legitimate in their deferral, as salaries aren't high enough - hope their underlying intention isn't that they'll target us anyway and turn up the pressure.
I remember reading somewhere that it was the defaulters and those who did a moonlight flit who were of most interest, and they would be where the bulk of the fight sits for Erudio and where the big bucks can be earned.
To chase and muck around with deferrers, who've played the game correctly all along, is incredibly unfair. Someone who defaulted long ago and maybe had a CCJ, could technically be sitting pretty these days without ever having to pay back the debt!

Cant see why childcare vouchers shouldnt be classed as income though. Just because it can only be used to pay a specific bill doesnt mean its not "income".

I pay the money out of my salary. Therefore they should have used my gross salary as I don't earn them. They are a deduction.does that make sense. I don't earn them. They have added the amount on my salary. So in essence they have taken my salary and added a deduction on again. Making my salary 2400 more than I actually earn gross. That's before the deduction.

  • Well, if they're incorrect and you know for a fact they are, keep on at 'em and the ombudsman. Don't naturally assume you can't fight it and then begin repayments. Scenarios like this, and I'm sure new ones we are yet to encounter are the tools they'll use over time to chip away and get legitimate deferrers into payment!
