My deferral by letter update too:
After been told I am now nearly 3 months in arrears I have sent them a letter explaining again why I refuse to use their DAF.
Also adding that in a reply to my MP, David Willets MP states that Erudio are developing a new form - therefore the current form must be seen as not fit for purpose and as such I will be not be signing it but will be more than happy to consider signing the new revised form when it becomes available.

Now that Lewy admitted to MSE that the deferral forms were inaccurate concerning that we had to fill out most sections, they should have immediately changed the forms. I understand people are still getting deferral forms but i wonder if it is made clear that the home ownership, NI number and such things are not necessary now? Basically, are they the same forms most of us got at the start or have they been amended?
I suspect that after each of us filled in the first application form for our 1st deferral, it makes no difference if they change their forms because most of us will have already given them that contentious information/authorisation (the purpose of which is still unclear to me right now). That the forms have been admitted to being off and misleading, then refusing to fill in the forms after that admittance is common sense and surely something the ombudsman or clowns at capita HQ would understand if it was clearly stated now.

I wonder when exactly Erudio were informed by BIS? Way before or as it went to press for the rest of us.
I'm 100% of the opinion that there's been collusion here and that this "plan" will have been agreed during negotiations for the sale of the loans to Erudio. Not everyone provides wage slips. But maybe it isnt a huge deal. It just seems an odd piece of info to ask for considering the deferment forms are marked up individually with our unique processing numbers.
Also, until we have evidence, how can anyone be 100% sure?0 -
Just gave Erudio a call, we got deferred which I'm obviously really pleased about. Filled in their form but left D/D details blank, didn't give them any phone numbers, didn't sign or return the data protection form either. Sent it 1st class recorded on 12/08/14, which they received on 13/08/14. Really surprised it has whistled through in less than a week after all the horror stories. Maybe we got lucky, maybe they are pulling their finger out, maybe some people have been economical with the truth regarding the return of their forms, who knows? If they record anything on my partner's file that has an adverse effect, I will complain to the ombudsmen as these loans were clearly sold on the basis that they would have NO effect on future borrowing and take it from there.
Next year might be a whole different kettle of fish though. She may be over the new threshold next year depending on her earnings and I fully expect the threshold to be lowered further next year because these s**thouses aren't gonna stop I promise you that now. Hopefully someone with a bit of clout will expose what's really gone on with these rats and bring the whole thing down but I won't hold my breath. The FOS are lame and largely useless and I wouldn't put my faith in Martin to sort it out. I think it will take someone really special to beat these. One thing's for sure, they won't be beating me. I'm fully prepared for what lies ahead now.

I can't promise anything but if I can help I'd like to. I haven't yet filled in my deferment form but I don't have a scanner.
I've not been very well the past day or so but if I can get to the library tomorrow I'll scan my blank form (with the customer ref. no. blacked out). I do need to get out to the post office in the next few days anyhow to get my deferment sent off asap!
In the meantime I'm just having a look at it and don't think it's changed. Still asks for all the extra info. such as NI no and address status. Can't see anything indicating that we don't have to supply this information.
What also strikes me is that the first page of their "Getting your deferment application form right" guide to completing the form states that "If you have a mortgage style loan and you have a gross monthly income below the current deferment threshold you may be eligible to apply for deferment".
I bolded the word "may". Seems they are trying to suggest we are not definitely entitled to defer, which of course we are if our income is below the (now even lower) threshold level.
The other worrying part of their "guide" is also on the first page where they say that "You will need to continue to make repayments until you receive confirmation in writing from us that your deferment has been accepted".
No mention of whether we can obtain refunds for repayments taken due to any delay in their part in deferring us.0 -
Great JetLaw, that would be interesting to see. It sounds like the same form. Does it have the one a third page CRA threat still tagged on to the end?
