    True, not impossible :) But think how much administration time has been taken up by the complaints, and future complaints about the forms. At this rate it'll cost them the equivalent amount of cash to our loans sooner than they think......

    And just think all that hassle could be saved if they just gave us a form that only asked for the info needed by law to defer, and didn't try to phish for info or con us into CRAs reporting we don't want. Simples.

    Too simple for those tosspots at Erudio.

    The Deferment Threshold from September 2014 might go down from £28,775 to around £27,000 (might be as low as £26,700) down to what it was five years ago.
    How can we plan our finances properly when we have little idea from year to year whether we have to pay back some of our loan or not.
    If the Threshold does go down then it’s down to Bankers’ bonuses and the way the Government does the calculations (they are done by the Government not the SLC).
    How unfair is that.
    Just been alerted to this post by the mumsnet forum, and i am very interested to hear if fairplay4all could drop us some more wisdom about this issue..or any issue in relation to all this. It passed me by when i read it but i would certainly like to hear of you have anything else to add.

    I did the same as you, completed my form and then saw the threads, but you could just black out the info you don't want to give them, and anything you don't agree to? I removed the FPN completely (bottom of page 5, all of page 6), by photocopying the original page 5 with the FPN part attacked with a pair of scissors :D There's a statement near the top of the DD mandate (page 2?) about the DD being a legal requirement during deferment, black that out too. All the personal info, most have only given what was required on the old SLC deferment form.

    All that seems to matter to Erudio is the declaration signature at section 9 of the form, people who have refused to complete the form have been told if they sign the form and complete NONE of the other details, that will be accepted. It's all hairy balls IMO - their FPN says if we submit the form, we're agreeing to Erudio searching our credit record, and if they accept the deferment application, they can pass our loan data onto CRA's. This is where they can make their money on our deferred loans (that, and reducing the deferment level by some random amount!). Seems like harassment at best, or coercion at worst.

    Remember none of this really matters, it's Erudio's nature and they want you to feel intimidated, but don't let them. All that matters is that you're legally entitled to defer, Erudio are just throwing a few obstacles in your path :)

    Thanks Anna. I have pre-1998 loans so does that mean it's not worth me crossing through the bottom of page 5 and page 6 as they can report me to CRAs anyway? Trying to assimilate all the info in here as quickly as possible but really need to get my form off tomorrow as doubt my deferment will be processed before my mid Sept payment is due.

    TraceyJ - My loans are pre-1998 too. Erudio are saying that they have the right to disclose our data for pre-1998 loans (under section 16), but it's by no means certain.

    I've emailed my FOS complaint (which is mainly about Erudio's non-compliance with the Data Protection Act and breach of contract if they disclose my info to Experian) to the lawyer who posted on Mumsnet, he's willing to have a look and give a legal view on it, I'll update on the thread when I hear back.

    So if you don't agree to your info being passed on to CRA's, it's best to remove the FPN and state that you don't agree to it and you don't consent to your info being disclosed.

    While browsing this thread I realised that I had not received a deferral pack for my student loans. After checking it would appear that they are now wiped out as I have reached the grand age of 60. After being disabled for several years, it is a worry that has been removed. I presume, at some point I will receive a letter of confirmation from Erudio?

    That's great to hear about the lawyer. Hopefully we've have some good news from them!

    I'm in the same boat as I have pre 1998 loans and I definitely hope we can contest Erudio passing on our info to CRAs.

    I'm certainly not signing anything that could possibly allow Erudio to claim that I've agreed to this.
