Smart Parking /ASDA

Think I should change my username to just 'genuine OAP' or 'increasingly confused'

Local ASDA have a pick up drop off area and I parked there to nip in and out, really wasn't there long. Ticket says (which confuses me more) vehicle with correct Reg first seen 12.41 ticket issued 12.07. eta

I had returned to car, found ticket, moved to free parking area and was back in store to query the same at 12.24, verified by security staff.

Have searched and read so many postings/pages regarding Smart Parking and ASDA that my brain has turned to mush. Been here,Pepipoo, Parking Prankster and others and am still no wiser. So much information! Is what was written/posted in2012/2013 still relevant/applicable? Are Smart Parking 'functioning legally now" Do I ignore, or appeal ?

Have spoken twice to various staff at the ASDA store in question (some say this and some say that!). Have obtained the telephone number for head office and will persue the conflicting information and advice given on those occasions.

I know ignorance of the law is not a valid defense but can I claim senility?

    First things first, pick up drop off is for that exactly, its not for short parking, but that is irrelevant.

    Did you receive that ticket stuck to the car? Where was this? Are you the registered keeper of the car?

    Ok, at this stage then the standard advice is to not do anything. You should receive a notice through the post within the next 56 days. This is the notice that you will appeal.

    In the meantime, read the sticky newbies thread to get acquainted with the process. There are also templates there to use for your appeal.

    Also, pop back to Asda and speak to the manager who should be able to cancel it (you may be able to use senility for this one). Make sure you get confirmation that it has been cancelled though.

    in future either use a parking space if parking (say for more than 5 to 10 minutes) or if dropping off then stay a few minutes only

    the theoretical limit on these decisions is 10 minutes although there is no hard and fast rule

    if necessary. you appeal to the ppc after the NTK and then to popla if you dont get it cancelled
  • Will speak to ASDA head office and see what they say. May go back and look at notices to see whether " Pick-up" has any legal definition regarding purchases or passengers with purchases?

    As said the local ASDA store in question were less than helpful with their confusing advice and information.

    I visit this store 5-6 days a week, it has a good amount of free parking and I do park appropriately. The day in question I had a health issue (not going down the explanation route)

    Just be blunt with them, either they cancel it or they lose you as a customer.
  • Smart Parking NtK's are not compliant under POFA to pursue the keeper - in other words they can only pursue the driver if known.

    If a complaint is made now to the head office - make sure that the driver on the day is not identified.

    It would be better to wait until the registered keeper - edit any post (don't say) receives the notice before making the complaint.

    You will beat this ticket and not have to pay anything.

    However people parking (not dropping off or picking up) as you did pi** me off when I want to drop Mrs Iceweasel off as near to the door as possible, or pick her up again when she phones for me to collect her.

    Nearly every Tesco & Asda store have the drop off points blocked by inconsiderate people who are 'just nipping in for a moment - won't be long'.

    Pick up /drop off has no legal meaning - as do none of the other special bays.

    But the whole ticket thing is cr*p so you can rest assured there will be nothing that they can do to stop you.

    Irrespective of 'health issues' try be more considerate in future to people who really want to use the bay as intended.
