Yes, it starts Dear Sir/ Madam
LETTER BEFORE COUNTY COURT CLAIM (all in caps)

Parking eye car park management at the top.
I threw the original 2 invoices away (because of old advice I'd read).

Please, just read the 'LBCCC Fightback' thread already linked for you. We can't re-type it and it's already set out with templates to send!

    Is this right?
  • As I said, I HAVE read it all, I just don't understand it! This is all stuff you guys know about inside out, it's NOT easy reading for a mum in between breastfeeding, wiping snotty noses, cooking etc etc. I'm trying my best, I really am, but it's so far over my head. :(

Yep we know - I am a Mum of four myself, all born within six years, so 'been there, done that'!

Anyway if you've read the NEWBIES thread it is NOT THAT.

And with the best will in the World, NONE of us is going to re-type Daisy's LBCCC Fightback thread which DOES tell you what to do!

  • So is this actually a LBCCC and am I too late for the whole appeal / POPLA route? At the moment I'd frankly just be happy to pay the reduced invoice however much that was for!!

looking at your links then yes its an LBCCC so gone wayyyyy past the appeals route, which you should have done in january and beat them easily at popla

this must be a new tactic of theirs as they were fighting popla appeals but went quiet recently so it seemks they are now issuing an LBCCC within 2 months of a contravention instead of waiting maybe 12 months and without goint to debt recovery

your best idea is to complain to the landowner and get it cancelled , maybe citing the EA 2010 due to the baby etc

but do not ignore this LBCCC and read the LBCCC thread I linked to by the retired solicitor daisy , and also read the parking prankster guides to fighting PE in court

At last! Yes you are too late to appeal (unless the keeper wasn't the driver) so get off the NEWBIES thread and onto the LBCCC thread which I think has now been advised to you half a dozen times.

And please 'wise up' - you CANNOT pay the reduced amount - don't pay ANY amount and just fight back with the help of the templates in the LBCCC thread - or name the driver if it wasn't the keeper (rewinds the clock to appeal stage!!).

    And complain to the landowner/retailer.

Yes it's an LBCC - no not too late theres nothing to stop them accepting a late appeal and giving you a POPLA code if they wanted - but you no longer have a right to it and would have to put up a fight to get it.

But why would you want to pay them - all is not lost - but only you can decide if you'd prefer to get rid of it by paying
There's a number of cases were things have been pulled back even after court papers have been issued
So calm down and take your time - nothing's going to happen right now
so over the next few days arm yourself with the information which will help you make an informed decision
