The registered keeper is not liable for this charge asBirmingham Airport is designated as an airport by the Secretary of State and therefore roads within the airport are subject to airport bylaws and so POFA 2012 does not apply. I put the Operator to strict proof otherwise if they disagree with this point and would require them to show evidence including documentary proof from the Airport Authority that this land is not covered by bylaws.
sorry i edited the entire appeal to tailor towards the circumstances and this is the only thing i forgot to replace as i've just re-read my appeal. do you thinl ibshpuld re-submit or let them know or is it a small detail? i submitted tje appeal around 2-3 weeks ago now. thanks everyone for helping up to now0 -
I would do so in order to remove any ambiguity. Provided your appeal hasn't yet been considered then you can add to it up to that point. make sure that you give clear details of your previous appeal.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
