parking charge notice - county court claim

Hi,
I have received a county court claim form from Northampton county court and I am not sure how to proceed and would benefit from some advice please.
I took the advice of ignoring various letters requesting payment and had not heard anything for about 10 months.
I had thought that was an end to the matter but now I will need to respond to the county court claim form.
The form specifies an over stay of less than 20 min in a 2 hour free supermarket car park approx. 18 months ago.
I would appreciate some help is resolving this and the best course of action.
Many thanks in advance

is it the coop and CEL ?
if it is check parking pranksters blog and other recent coop threads on here too0 -
Thanks RedX,
Yes, you guessed correctly.
I plan to read up tomorrow on advice and try to make a defense if I can as I feel these companies are making easy money from their unethical business plan.
I'd rather have paid a parking fee and known where I stood than to have been filmed by a camera system I was not aware of and assumed the parking ticket machine was faulty because it was still in situ at the entrance of the car park.
Thanks for responding so quickly0 -
but if you had read the pranksters blog and the other threads here and on pepipoo you would know people are complaining to the coop and the tickets are being paid
why do you think I told you if this was not the case ?
unless you wish to go to court ? in which case feel free to ignore my replies ?
thanks0 -
You would also have found this discussed on other Co-op threads here too. The Co-op are paying these.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD0 -
Thank you for your reply,
I have emailed the CEO of the co-op to see if he is willing to pay the notice on my behalf as has been the case for a few others who have complained.
I have just emailed the county court to say I will put up a defence.
I am a NEWBIE and it has taken quite a while to work out what to do.
I have found the whole process of dealing with this PCN very stressful but wanted to stand up to what is a very nasty business model of these companies - most people are quite happy to either pay for a parking ticket from a machine or stick to any reasonable conditions that are clearly signed for "free parking".
That's why I am trying to hold out as they are just extortionists out for every pound they can get.
ANY help with a defence would be appreciated thanks0 -
What do you mean you have e-mailed the court? Have you submitted an acknowledgment of service via money claims online?0
-
You don't email defences to county court claims, you must follow the procedures set out in the small claims pack you've had. Now please clarify where you are at with this, and have you written your defence yet? Kirby will probably pick up on this, follow his advice carefullyWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

HI,
To clarify,
I have emailed THE ACKNOWLEDGEMENT OF SERVICE to say I intend to defend all of this claim. it has to go to the court via email address ccmcce-filing@hmcts.gsi.gov.uk that's what it says on the documents I have received with the county court claim form.
I then have to 28days from service of particulars of the claim to file a defence according to the notes provided.
It is regarding CEL and Co-op.
like I said earlier the whole thing is quite scary for someone who has never been in a court type situation before.
Does it now sound right to you guys ? thanks for replying0 -
Try not to worry - scaring people is what these companies rely on.
Also it's only the small claims court and you will be able to get the case transferred to somewhere convenient for you to get to - if it comes to that.
Let's hope the Co-op help you out and it never comes to that
In the meantime you'll get lots of help from some very knowledgeable people on here about what you need to do0 -
I haven't written a defence yet - that's the bit I find so complicated as it's all the jargon legal terms and defences that are so alienating to the ordinary person.
Any help with this part greatly appreciated and many thanks for all comments so far great to know that there is so much support on this matter.0
