Her tenancy's periodic, right? So YOU have to give HER two months notice, but SHE only has to give YOU one month.
Dafty's right. For the sake of a fortnight's rent, how far do you want to go? Your lack of a financial buffer is not her problem.0 -
Thanks for your advice guys, I agree it is my financial situation that is making me dig my heels in a bit which I know is not her problem, I probably will just let her go but it does grate a bit that she is dropping me in it a bit when I tried to help her out a lot 12 months ago.

As she's receiving Housing Benefit there are rules which would allow your tenant to receive benefit to pay for both her new rent and the rent on your property for up to 4 weeks. This is allowed if the overlap is unavoidable.
So, for instance, her tenancy with you ends at the end of April and she moves in to the new property at the beginning of April and receives 28 days benefit for both properties to help her avoid debt. The main proviso is that she has to have moved into the new property (except in exceptional circumstances) to get this - she can't sit in your house and move on the last day of the overlap or she'll not be entitled.
Then either you can chase her father for the shortfall, she's able to find the shortfall or you can more easily write it off.0 -

You can't have your cake and eat it. Your property is empty, you can now sell without hassles. Your tenant gave you two weeks less notice - that's the worst of your troubles. It could have been a case of your tenant not paying, refusing to move out and refusing to let people view the property.
In my view, it's much less of a headache now.
(I'm taking this stance, as a landlord did the same to us, told us he was going to sell, but asked us not to look around, put the property on the market and two days later it was sold. He STILL didn't want us to sign anything else until the buyer had two surveys done. We went looking for a place in an absolute panic, and since we have dogs, it's not the easiest thing - when we eventually found a place, he was pretty upset at first that we would move out before contracts would be exchanged. It was one of the most stressful things to go through and it was all because the landlord was so incredibly greedy!!!).0 -
We'll I spoke to her and she's not happy obviously she is saying that we have forced her out, which we haven't and also saying that there are jobs in the house which haven't been done (the only things not done are things she has only told me about today, other than she felt the house needed new windows and boiler a few months ago ) I have her rent in a protected deposit account and the agents have said this could be offset against it but she could (and probably would argue this). The email she sent me states that she has asked for the earliest date possible to get into her new property so I am sure that it could be delayed by a couple of weeks.
As far as me trying to get as much out of her as possible before the house sells, I'm not, the house is up for sale and we do have interest but no definite sales. Even if we had a sale tomorrow, the likelihood of it completing by end April/may is unlikely. And so I'm aware there are going to be months where potentially there will be no rental income. This I'm comfortable with All I wanted was what was contracted. I'm sure if the shoe were on the other foot andI gave her notice tomorrow and only gave her half of the required notice period, her attitude would be different, but I tried to be as open as possible.0 -

I am all for tenants using their legal rights, I know mine as a landlord.
Section 21 of the 1988 housing act says I always win.
If the landlady wants to be down hundreds of pounds due to letting this tenant go, then that is her perogative. She wanted advice, and got it.Well life is harsh, hug me don't reject me.0 -
Going to see what she comes back with as I still have her references to complete anyway. Certainly not going to rush to return them0
