faulty dyson bought from comet do dyson have to replace it?

I bought a dyson nearly 2 yrs ago and it has never worked properly. I have the dyson engineer out 3 times. today I turned it on and it just cut off. the warrantee is due to expire 2/4/14. the last time the engineer came he agreed it wasn't sucking up properly and I asked if they would replace it and he said the new models with smaller tansk for the rubbish aren't as powerful!! no help to me.
my question is if it is faulty do dyson legally have to replace it? I bought it from comet and they are no longer open!!

Have a read of your warranty documentation.
When you made the purchase at Comet, did you pay by credit card, or some other form of credit?
If so, your credit provider may well be equally responsible with Comet for performance of the contract.

The "full size" ones have a 5 year guarantee and the handheld models are 2 years.
However, these are the current times, and it may have been different when the OP made their purchase.0 -

Ive just checked and I paid for it using my Mastercard, what would I have to do to get Mastercard to replace it?
I think dyson told me it has a warrantee of 2 years.
its had 2 new brush bars and a whole new front as that was faulty. the pipe that connects the head to the hose was also faulty and that has been replaced.
I don't have pets or children and its only used a couple of times a week and for the first year it was only used upstairs, my point being it isn't over used or used to pick up hair etc that can clog.
I think it is a faulty machine and I have said this many times because of the issues we have had with it.
any advice is greatly received

Is that a mastercard debit card or credit card, and how much did it cost?
To stand a chance of getting the card provider to provide a remedy then it will need to be a credit card, and to have cost more than £100.0 -

Yes, you have already told us it is a Mastercard, but Mastercard do both debit and credit cards.
Is yours a credit card or a debit card?
If your card is a credit card then again I say read the article mentioned in post #2 to understand the process.
In particular, look at the How do I make a claim? section, and you will find:To make a claim, you need to contact your credit card company (you can still claim on an account that's closed) not Visa, Mastercard, or Amex. So if you've got a HSBC Mastercard, you claim from HSBC, not Mastercard.0 -
