Buyer not happy wants a refund

I sold a "designer" used childs tracksuit in excellent condition. Described as aged 9 - 10 as per the labels in the top and bottoms.

The buyer left me positive feedback earlier saying "Like new, very pleased indeed. Many thanks!"

Now I've had an email from her claiming that the sizing of the tracksuit bottoms does not match the advertised sizing on the "designer" website and that they are flapping above her daughters ankles ...

Am I wrong in thinking that she would be responsible for return postage costs

I asked her to double check the labels and got this reply
Thank you for responding so quickly. Yes they do, it was the first thing I checked. The size in the label matches the age you stated, according to the **** website. Sadly, the tracksuit is of no use to my daughter with 3/4 length bottoms. She needs it for school, and the requirement is full length.

My reply :
I don't know what to say, my listing was described correctly for the sizing. Could I make a suggestion that you list it on Ebay ? To comply with Ebay refunds, you would need to send it back to me via recorded mail which costs £3.70 (not £3.50 as I charged) so you would end up out of pocket as well. I had plenty of watchers on this so don't think you'd have trouble selling it.

Her response :
hi there, i think this would be considered suitable for a refund as "item not as described". i had thought about relisting so that you would not be out of pocket (return postage would be your responsibility as you misrepresented the item). i would be happy to do so as long as any shortfall in the winning bid was met by you

Am I wrong in thinking that she would be responsible for return postage costs if I accepted the return. I thought I'd made a reasonable suggestion in her selling these on. I've received a few things over the years that don't fit and have just sold them on again stating they would be suitable for the next size down. After reading through her feedback she seems to be a serial complainer with several comments along the lines of great ebayer, covered return postage costs !

    Tell her to send the item back for a full refund - return postage should be her responsibility and to make sure she sends it back tracked. Once you have it back do the refund of the item price and the postage you paid.

    Doesn't it just mean her daughter is above average height for her age rather than the item was mis-described??

    Tell her to open a Case if she is unhappy, and you will refund it on return. Do not pay return postage unless you are a business seller.

    I don't sell very often on ebay but this would annoy me. Basically, her daughter is too tall for the tracksuit, you haven't "misrepresented" anything, nor is the item "not as described"

    She has already left feedback and presumably your stars were ok so I'd reply, telling her that as you listed the measurements accurately, you have no case to answer and you're not going to accept the return.

    Of course, she may well make life difficult by opening a case anyway, in which case, you'll probably end up having to refund her because ebay have no sense when it comes to idiot buyers. It may be worth fighting it though, you have her messages in which she admits that your measurements were as stated on the manufacturers website. I can't see how she should win any case, it's not SNAD and she can't deny receiving it and claim INR.

    If you do decide to refund, you definitely shouldn't pay the return postage. It's not your fault that she can't be bothered to measure her kid's legs before buying stuff. Cheeky mare!

    I read the complaint as the buyer checked the designers page and checked how long the trousers would be and the length would fit her daughter but the trousers are in fact not the length they are advertised to be. Can I ask OP, as you have put the word designer in quotations is the item a fake?

    Hi all,

    Im after some advice with an item i recently sold, it was a used Abercrombie and Fitch Tshirt, it was a size Large womens which according he website is a size 14, which i agree with as i wore it when i was a size 14 and it fitted fine. I have recieved a message from the buyer stating that she is a 'slight size 12 and the tshirt isnt as baggy as i like mine to be' and has requested a full refund. As a private seller who has provided the info am i at liberty to refund her as i feel that i have described it accurately and that it not being as baggy 'as she would like it' isnt actually mine fault.

    Feedback please?

    Personally I think you have been fair with the description and the buyer cant expect you to know how baggy she likes her t-shirts to be!

    I agree with previous posters. You have not misdescribed the item. Its her lanky daughter thats 'not as described'.
