wrong date on parking ticket

I was issued with a ticket from a private firm. they are registered with the bpa. they have written one date on the ticket, and a different on the notice requesting fine, neither of which are correct. so I can honestly argue I was not parked there on that date. has anyone had experience with challenges like this and been successful or can anyone advise?

It can certainly help. I'm going to ask a question which hopefully won't offend, often the Notices to Keeper have two dates on them, one is the issue date the other is the date of event, are you sure you're reading the right one? If you are then on the appeal to the Private Parking Company you need to be careful how you phrase it. I would say something along the lines of:
"I am also in possession of a notice which was attached to the vehicle. The date on this does not correspond to the date on the notice which I have received by post. As such I assert that you cannot prove the date and time on which the alleged incident happened and as such you are unable to rely on any liability against me, as the registered keeper, under Schedule 4 of the Protection of Freedoms Act 2012."
This is only suggested and I am more than happy for other users to pick it apart.
It might also be worth submitting a copy of the original ticket with your appeal, just incase the person who made the mistake has tried to cover their tracks.0 -
If you can, time your appeal so they cannot correct themselves.
Following the windscreen ticket, they must give you a correct notice to keeper between day 28 and 56.
Don't do this if you run out of time to appeal though.
Your appeal reason is then;
The NtK did not specify the correct information as required by POFA (namely the date of the parking event). Therefore keeper liability does not apply and you can only pursue the driver. In addition, your charg is not a true pre-estimate of loss. Please therefore either cancel the charge or provide a POPLA codeDedicated to driving up standards in parking0 -
I would put the extra bits at the top of the standard appeal letter (contained on the newbies sticky), you probably still want to cover the usual bases.0

thanks for the replies. I parked in a private area on the 7 dec, the ticket says the 10 dec. I ignored the ticket in the first instance and waited until I received a letter from the company (CPS). They sent a letter and gave the incident date as the 8th dec. I replied to them and informed them that I was not parked there when they said I was (i.e. the 8th dec) and made no mention of the ticket. They did not reply to this letter but forwarded to a solicitor who has written to me telling me to pay otherwise they will instruct their client to take me to court. Again this letter refers to the 8th dec. Even if they did take photographic evidence it will presumably be for the 7th and not the 8th or the 10th.

Did you not get a popla appeal number? It could be they (deliberately) misinterpreted your reply and did not accept it as an appeal. Have you checked their letters fully for a popla number?I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

no, no verification number. the advice in the letter is to reply to them disputing the charge in the first instance, which I did. they have simply forwarded to a solicitor.0
