Absolutely furious and upset

I applied for a Nat West Credit Card and did a large 4 figure balance transfer to Capital One. However, I mistakenly typed two digits of my card number wrongly on the computer keypad so the payment went missing.

After 6 weeks of communicating between Nat West and Capital One, it has been established that the money has been credited to someone elses card account.

I've been told by both Nat West and Capital One that neither party can claim this money back, until the cardholder who has it decides to give it back. The cardholder is not playing ball though and refuses to return the money.

I've been told there is nothing either party can do as it was my mistake. So instead of trying to save a few pounds in interest, I've managed to double my debt and now I'm going to have to cut back my already tight SOA to meet payments on both cards.

Very expensive mistake to make, and I'm really angry and upset with myself. Just posting this as a warning to take care when entering numbers as it can cost you dearly if it goes wrong.

    That cannot be right, surely natwest can recall the balance transfer, its your money after all. Call up capital one and if you don't get anywhere, ask to speak to one of the managers. That just doesn't sound right.

    I've spoke to Capital One again. Both the telephonist and their manager said there was nothing they could do if the person who has my money doesn't want to give it back.

    Tried Nat West again and was put through to the department who deal with balance transfers. They apologised that the original person I spoke to told me the wrong thing. They said they can demand the money back from Capital One, but it can take a few weeks to process.

    At least I'll get it back eventually, but it just means things will be tight for the next couple of months while I've got a balance on both cards.

    That is complete and total rubbish. There is no way that they can keep the money. It is the same principal if someone pays some money into your account by accident or if you are over paid by your employer. It may be their mistake but you cannot keep the money, its simple really.

    I would get back to them and create merry hell as it seems that they just can't be bothered to help.

    I would ring back Capital One and give them hell for very bad customer service. Quite how they can claim that it is up to the individual to choose to give it back is beyond me. After all we are talking about Credit cards here so the money pretty much belongs to Capital One anyway rather than the individual.

    i think in the eyes of the law, that's theft.
    Even though that person didn't take your money, they know it's not theirs and should return it.
    The fact that the person is making a concious decision not to return it amounts to theft.
    I'd also argue that Natwest and Capital One are accessories since both know it has happened but initially refused to help.

    That really is terrible. If Natwest had accidentally overpaid someone do you think they would say the same? No they would claim the money back straight away. Its a good job you carried on questioning it else nothing would have been done. Glad to hear you are getting your cash back:T

    Try phoning the ombudsman for advice, it doesnt right at all.

    Please note the daily £xx.xx has appeared in my bank account, the bank has asked for it back, do I really have to posts that you will see that this site is littered with.

    The responses are always littered with "I know you shouldnt but I think you should keep it" posts that makes one wish one lived in another country.

    If the person refuses to give the money back it is theft and they can be imprisoned for said crime. Quite whose court the ball is in at the moment is another matter.

    The ombudsman can do nothing until one has been through the banks entire complaints procedure.

    There are equal numbers of indignant people who would complain if the bank had taken it away without asking. I am unsure of the situation with credit cards, but currently if a payment is made mistakenly into someones bank account the bank has to ask for it back.
