28 Day warranty

    OK - SOGA versus six month warranty (assuming a PROPER warranty) on an 80K mile car.

    Under the SOGA the seller is obliged to repair any FAULTS that are deemed to have been present at the time of sale. The seller is not obliged to cover anything that could be deemed to be wear and tear. So if a turbo went after 5 months, it would be reasonable to assume the fault was not present at the time of sale, as the car has been driven by the purchaser for five months with no problems, therefore the seller would not be obliged under the SOGA to replace it.

    A Warranty will provide cover for FAILURES during the term of the warranty. Usual exceptions being serviceable items, such as clutch, exhaust, tyres, brake pads, etc. If a turbo failed after 5 months, that would be covered under the Warranty.

    So a warranty is "on top of" the SOGA in terms of adding extra rights.

    The mention of the 28 days is not an indication of attempting to limit the buyers rights, in the same way as someone advertising a "3 month warranty" isnt.
