They could be liable to, but only if that was part of the contract.
I don't think it would be, without additional cover being taken out.

There are individual pieces of legislation they must comply with, H&S, SOGA, DDA, CCA, DSR etc but there is no over arching regulator like there is for banking, insurance, energy etc0 -

Mobile devices are handheld and therefore it should survive being dropping. Just because you can doesn't mean you should.
If its marketed as ruggedised then it needs to be able to withstand rugged treatment, if you drop a normal device it is not reasonable to expect it to survive in all scenarios.0 -

Mobile devices are indeed made to be held in your hand and therefore should stay in your hand, they are not supposed to be dropped onto floors. If you say your Nexus has survived two drops onto concrete then you must just be very lucky.0 -
