Invoice in the wrong name.

I've recieved an invoice to my address that is not in my name.

The invoice is owed by me, I know what its for. I've spoken to the company a few times who have reassured me that they will put the correct name on the invoice and resend it. It's all gone quiet for a few months and I've now recieved a letter from controlaccount.com which I assume is some kind of debt recovery company.

Am I being silly to expect an invoice with my name on? At the end of the day, by law I suppose I shouldn't actually have opened these letters since they're not addressed to me.

Any advice?

    By law ... you are legally allowed to open any mail addressed to your property, even if it is to a name not recognised, as long as you are not intending to deprive or otherwise harm or inconvenience the named recipient.

    So with that out of the way ... write back to Control Account (and yes, they are debt collectors) to say the debt is denied against the named recipient and to refer it back to their client, so that a formal invoice correctly-named can be issued - as has already been agreed with their client!

    (I'm assuming they are representing the company whose invoice you are awaiting, rather than they having bought the debt).

    I don't know the legalities of a company not sending an invoice in the correct name i would keep sending the letters back as 'not known at this address'..
  • If you know it's yours and you owe the money why not just pay and save yourself a headache later on down the line?

    Because I'm concerned that having paid it, I may then recieve another invoice in the correct name and not have a leg to stand on when claiming to have already paid it because it isn't in my name.
    I know it sounds unlikely, but given that they're already trying to claim against someone who doesn't exist despite having been told numerous times that person doesn't exist and having the correct name spelled out to them.......

    If the OP pays an invoice with the wrong name on, what's to stop this or another debt collection company coming along with another invoice with his name on and demanding payment for this ?

    I know what the invoice is for, I haven't got a quibble with that, just that it isn't addressed to me. I am worried about my legal standing should I get subsequent demands for it having already paid it in a another name.

    I just don't trust the company to get this right given their performance so far.

    The name is completely wrong, not just a letter or two wrong. The cristian name is spelt wrong and the surname is completely different. So as an example if my name was Katy Smith, They've addressed it to Kate Silverdale.

    At the moment the invoice doesn't belong to the OP as it isn't in their name regardless of the account number, address etc. Can we presume the entire account is in the wrong name if the company have passed it on to a debt collector and the OP is getting letters with the wrong name on the letters. I too wouldn't pay a penny until they have corrected the problem, if i was you OP i would also check your credit report and see if they have put anything on under your name.

    Strange question. They have already said they owe the amount of money printed on the invoice for the goods, to that company.

    It may be that 'Kate Silverdale' has also ordered exactly the same goods and owes the same amount, and OP is being sent her invoice. Or it may just be that the company have messed up the name. Either way, it's for the company to correct.
