I've just received a "Parking Enforcement Penalty Notice" from a company called Civil Enforcement Ltd for apparently overstaying in the co-op supermarket car park in Whitby by 9 minutes and 7 seconds.
This happened 4 weeks ago so I have no memory of whether this is correct or not (they say they have photographic evidence but I'd have to pay £10 to see it) - I don't remember being late back to the car but it's possible I was. All the previous times I'd parked here you bought a ticket and made a purchase in the shop - it's obviously been changed fairly recently and as the barriers were up when I drove in I didn't pay much attention to any signs there might have been. Anyway the "fine" is for £90, or £45 if I pay within 14 days. Where do I stand with this? I've seen other posts saying just ignore them but it's easier said than done, especially if the amount is going to double with every letter they send. Any advice on dealing with this company or from someone who's been or is in a similar situation would be appreciated!

Hi taffy056,many thanks for advice and will take such by ignoring the invoice,as they have also in my opinion failed to even support their dodgey claim with any evidence at all apart from an invoice which i suppose anyone could send to anyone or they could simply target car parks controlled or otherwise with spurious claims a bit like myself dressed as a parking attendant charging and issuing a fake ticket...nice work if you can get it.....,perhaps the alleged and untampered with"photographic evidence" if it exists will be made available to both myself and the courts for free...lol!!!0

Don't hold your breath - Photo "evidence" has no meaning at all in the context of private parking. Its just another scare tactic.0

Why? Let them keep doubling it. They could ask for a million quid if they wanted to. Just as easy to ignore and no more enforceable than the original £45!0 -
Thanks to all the replies on the "Whitby parking" and sound advice,seems such a pity that this sort of thing is allowed and therefore condoned by the local authorities,this sort of practice only discourages visitors to this town and does not help the local business's grow or survive, I for one will not be visiting this town again...0

Check out my post - I'm dealing with one at present. I've had my reply to my "reasons I might have been late" letter which was not an appeal, more of a list of reasons not to pay - they said tough, pay up, another 14 days to pay (waste of time as I'd no intention of paying at all). Then a week later I got my Final Demand in a brown windowed envelope with a very strong hint of what is inside (for further intimidation).
The trade code of practice says there should be adequate warning (there aint), a gap of at least 14 days between their answer to any query of correspondence and the Final Demand. Oh, I forgot to mention they also ought to provide an email. My memory is awful - I should have said - nice lady at the co-op phoned me to say she had cancelled the charge just before CEL gave me that extra 14 days to pay and I have her conversation recorded on my mobile. (app = "Record my call" and it's free!)
No way will I pay - they had a chance to negotiate a realistic figure (I had in mind about £1.50 but mentioned no figure). On the contrary I've reported eight points of contravention of the BPA code of practice to both BPA and DVLA and await their suspension from both with glee. I've also reported the intimidating process to Police and direct to OFT. The more who do likewise the better the chance of some success against what are nothing more than latter-day bully-boy clampers. Thugs!
Try this email address for Police at Whitby if you feel there is any attempt (there is every attempt) to intimidate you into paying.

Many thanks to couponmad and all responders,I have just recieved yet another demand from these people which I have duly filed in a suitable place for re-cycling in to toilet paper..if this persists I think i'll take it up with the Whitby police as harassment as advised in earlier posts,perhaps the town really does'nt need tourists anymore and this is a good way of detering people,its certainly deterred me.
These are bigger bloodsuckers then the vampire that this town portrays!!0
