Tech fault on previous flight, can I claim regardless??

Apologies if this is covered elsewhere on this very long thread!
My outbound flight from Heathrow (MH003/06) arrived 1482mins late at Perth Intl. Airport because Malaysian Airlines claim the inbound flight MH002 (operating the MH003) supposedly experienced a technical defect with the braking system.
Writing to the Civil Aviation Authority to confirm this sounds like it will take years to get a response, so does the fact that the fault actually happened on the previous flight to mine mean I can claim anyway?
