Used car - wanting to reject...

    Just because you have the "right" to a refund, doesnt automatically mean you will get your money back.

    Possibly not but usually a letter requesting a refund under the sale of goods act and a copy of document from a garage listing immediate faults usually does the trick in majority of cases.
  • I bought a 3 year old car on (61000 miles) from Arnold Clark Liverpool less than 6 years ago. I tried to reject the car within 2 weeks of purchase for various faults. I discovered there was no MOT on it (the first MOT) and illegal tyres (yes I know I was stupid not to spot them). They did the MOT and refused to pay for the tyres I had put on to try and keep it legal. Then had to return the car again due to starting problems and black smoke from the exhaust. They replaced EGR and the tensioning belt. It went into limp mode the minute I left the forecourt. I told them I wanted to reject the car, they refused and insisted I removed it from their forecourt. Tradings Strandards (not much use) were involved and a letter from me to head office of the dealership whet unanswered, I gave up trying to reject the car. I had ongoing problems and replaced the trubo at substantial cost but still endured starting problems and black/white smoke from the exhaust. I have done 40,000 miles and the car and it is now only worth scrap value as the engine has cracked cylinders and piston damage (all original seals and gaskets are in place) which leads me to think it was an existing fault at purchase and/or manufacture. I am a single mum and I only finished paying the loan for the car last year. I feel utterly let down and totally ripped off. Any advice welcome.

    Hi, thanks for all the replies. Just to keep you posted the dealer has been very accommodating after I sent an email stating my rights and what I actually want doing.

    It is now being repaired at Mercedes, with Mercedes paying 75% of the cost due to a possible manufacturer fault, and fixing a bracket so it doesn't happen again, and us and the dealer paying the 25% between us.

    Now I know people will say we shouldn't have to pay anything, but the problem we have is that there should have been warning light that came on to alert us to a problem, and although I can say there wasn't, I can't be 100% sure, again possibly a manufacturers fault? I am also considerate to the fact that we are using a Mercedes garage to get our car fix, whereas the dealer could have requested to repair it in a garage of his choice.

    Rejecting the car may have meant going to the small claims court and still waiting for our money, in the meantime out of pocket with no car. I was prepared to tow the car back to the dealers forecourt and leave it there, at least this way both myself and the dealer are on relative talking terms.

    Op, see why you are making a contribution. Enjoy your Smart car, we love them.
    Make sure the work done by the Merc. garage has a waranty and that your name is on it, Merc. are generally good but you can't be too careful.

    I know some may say you shouldn't have to pay anything - but I don't think you've done too badly by paying 12.5%. Which I suspect will amount to the cost equivalent or less than a round of tyres. Many people get diddled with used cars so in the grand scheme of things I don't think it's a wholly terrible outcome.
