Can you clarify if your husbands current problem is directly related to his ongoing health problems.

The fact that you booked the holiday originally might suggest that you wouldn't have anticipated any problems at that stage, so if his current issues don't directly relate to his historic health problems then you might still en justified in lodging a. Claim though your insurers.

Sorry, just realised you said it is related.

Could you get your gp or specialist to provide some support to the fact that this deterioration wasn't seen as probable at the time you booked, it could sway a decision for a payout.

I'm not so sure that this is clear cut, as I think the insurers may struggle to demonstrate this could be reasonably foreseen at the time you booked. After making a claim and if it is rejected you can go to the insurance ombundsman for an appeal and determination.

No GP or consultant would be able to answer that question...the tumour was successfully drained but with tumours there is always a strong chance of them again becoming a problem . I think the insurers would find it quite easy to demonstrate it was a possiblity...

Anyway OP have a word with Thomas Cook...go armed with a letter from your husbands GP and you never know they might show some goodwill and transfer the holiday to a later date..free of charge or for a nominal fee. I wish you all the best and hope his surgery goes well.
  • thanks for all your great advice, the illness my husband has isNeurofibromatosis is the name for a number of genetic conditions that cause tumours to grow along your nerves.
Tumours are abnormal tissue growths. In neurofibromatosis, the tumours are usually non-cancerous (benign).
There is currently no cure for NF2. Treatment involves regular monitoring and treating any problems that occur.

Surgery can be used to remove most tumours, although there is a risk this will cause problems such as complete deafness or facial weakness. Therefore, the risks and potential benefits will need to be carefully considered before treatment.he found out he had it in 2000, and over the last few years it has got worse, but once he had the tumour drained last summer( because he was complaining of headaches, my self and the doctors at the john radcliffee hospital thought the tumours would be ok and stay the same sizes and not grow again.... some of his tumours have not grown in last 10 years....

so yes when I booked the holiday I was aware my husband had tumours over his body but I was not to know they would grow again so quickly....

Possibility isn't enough for them to get out of the claim though, many things are possible. I would make a claim and follow through with an appeal to the ombundsman, as I think it's a reasonable chance of success, and doubt they want the bad publicity of refusing given the circumstances.

I've been trying to think of an analogy that might work. Possibly something along the lines of having an elderly parent who and ongoing health problems but who deteriorated very quickly just before a holiday, this was an eminent possibility but the exact timing wasn't known at the time of booking even though it's no great surprise that they might get worse, it's just that the timing of that couldn't have been foretold.

Good luck with whatever you decide OP.

Have a. Look on the financial ombundsman website, there are examples there of potentially similar cases that the insurer has refused and the ombundsman has overturned in favour of teh policy holder or complainant.

Check your travel insurance policy under Medical and Close Relatives. If often refers to the health or pre-existing conditions of "someone who is not travelling, but on whom the travel depends". That means the health of anyone who is not going, but if anything happened to them, you might cancel.

However some policies have a clause that covers you if a GP will confirm that, at the time of taking out the policy, there was no known reason why the trip may be cancelled. The insurance company's get out here would be that your husband had a condition that was known.

Good luck and keep us posted.
  • ive phone the holiday company(Thomas cook) im not cover they say I would lose 90% of the holiday if I don't go on the date im due to fly....
contact insurance policy and that stated im not cover so cant claim...

if I try and change dates it would cost me £1,900, or if I don't go it will just show as a no show at the airport.....
so both ways I lose the holiday unless I choose to fly out on the day and run the risk that my husband gets worse while im away.....

did you book instore? maybe they might be more sympathetic or helpful.
a few years ago i had a holiday booked with thomson, i was unsure until close to departure whether i would be able to travel, i explained this to the shop where i had booked the holiday, they were very helpful and told me i could change the dates of travel, to the following year if need be. but obviously there would have been an admin charge.but nothing extortionate.

You surely wouldn't want to go so far away only a week after your husband has brain surgery?

Not sure that is relevant. The OP is asking how to go about getting a refund or not, not wether she should go or not
