  • So if an item comes in a big brown box in effect what the littlewoods rep is saying is that you need xray vision to inspect the item through the package cause if you've opened the box to inspect it you've accepted it !

Can't imagine many courts would agree with the interpretation littlewoods rep has given !

FWIW I doubt very much that the Littlewoods rep statement
By opening and building the bed, we would say that the customer has inspected the goods and has accepted the goods as they are.

    has any legal weight whatsover.

This is going to be interesting.

    Hi liz and Andy
Goods can be rejected under the Sale Of Goods Act if they are" not as described"

As the model that was described in the catalogue is not the model the op received, of course she can reject it..

This reminds me of the time Next sold Me a pair of sandals for my husband.
When we were on holiday I happened to look at his feet and noticed that.. One was bigger than the other( his sandals , not his feet) .
Yes, one WAS a size 9 while the other WAS size 10 ( don't ask!! Men!!) :D

I took them back whereby the foolish member of staff told me I couldn't return them as they had been worn.when I protested I was told they'd asked the manager and she refused a refund.
I rang the head office who ascertained the manager hadn't been told and obviously as they had sold me the wrong items they were to blame and told me to return them for a refund.

Andy and liz I suggest you speak to your manager..

    Popcorn ?

I suspect this is company policy so talking to a manager will have no effect. They knowingly try to flout the law, because they know that most people will fall for their spiel and give up trying to assert their legal rights. The few cases where the customer does know their stuff, Littlewoods will eventually settle just before it goes to court.

What they don't take into account is that their customers talk, and their poor customer service reputation spreads further and further. So trying to save a few pennies today costs them dearly in the long run. It was one reason why Comet went under, and it will take Littlewoods down too eventually.

It's probably just best to report them to Trading Standards, to hasten the process.

I'm a little surprised they are willing to engage so much on here. I would have expected them to just direct people to a customer service number or email to avoid the possibility that something would be posted that they later wanted to retract.

The engagement on here is making Littlewoods look (frankly) stupid. People showing them they are wrong, not flouting their rights and you get a comedy response.

Come back Littlewoods! Show you have some balls and admit that you are actually wrong in your posts and you have helped the OP by coming to their house within a reasonable timescale, delivered a new bed, taken the WRONG one away and given them a token of apology in the form of a free duvet or something!
  • I bought a dyson nearly 2 yrs ago and it has never worked properly. I have the dyson engineer out 3 times. today I turned it on and it just cut off. the warrantee is due to expire 2/4/14. the last time the engineer came he agreed it wasn't sucking up properly and I asked if they would replace it and he said the new models with smaller tansk for the rubbish aren't as powerful!! no help to me.
my question is if it is faulty do dyson legally have to replace it? I bought it from comet and they are no longer open!!

    I hate dysons!!1
