    FURTHER UPDATE: In parallel with the Co-Op's decision to pay the charge for me, I have today received 2 further pieces of correspondence:

    1) From the Co-Op Legal Department, saying that they are not the appropriate people to substitute for the Claimant and that they believe that an attempt to do so will fail. (I'll scan a copy of this letter and email it to the kind person from here who has been helping me).

    2) From Nottingham County Court, saying that this is now a "defended claim", that a copy of the defence is attached (it is not!!) and that I need to complete a Small Claims Direction Form (N180) and to "serve copies on all other parties".

    pm from another worried poster directed me back to look at these.

    Having done so, wrote back:
    'My view is that this makes them[sic=co-op] even worse, actionable even, and I'd not worry. Should you-and others-receive such responses it indicates a desperate pattern of attempts to balance books by any means.
    Doesn't that seem a more sensible interpretation?'

    This - esp. as wider Co-Op have delayed their results[as heard on r4 this a.m] and here:

    CLOSURE: I have received a letter from CEL to say that they acknowledge receipt of my payment, and that they have discontinued proceedings and have informed the Court of this.

    So it's a result (of sorts), though it saddens me to see the Co-Op handing over money to these monkeys.

    Many thanks to all who assisted me and also those who posted supportive messages. And the best of luck to everybody else who has to fight an unjust and unfair parking penalty.

    It wouldn't be the first time that a PPC "forgot" to notify the court.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Yes get confirmation from the court as well
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • Hi, firstly i would just like to say im new and this is my first ever time on a forum and apologies in advance if ive posted in the wrong area etc,

    i was hoping for any kind of help if possible.

    3 years ago my partner got a parking fine from civil enforcement for parking our car in a car park without displaying a ticket. This ticket must have been issued from a camera as no actual ticket was given on the day.
    She was there for 20 mins waiting to pick a friend up from a train station opposite and never actually left the vehicle. The car park no longer exists as it was derelict ground adjacent to a unused office which has now been built upon.

    After reading through some advice at the time we chose to ignore it as we thought they actually have no right to charge us. 3 years goes by without any letters until 2 weeks ago when we received a notice from Northampton county court. Firstly we had no clue what this was about as it was 3 years ago. Once we saw this we filed an acknowledgement of service and now we are stuck as to what to do next in terms of defence. we cannot understand why all of a sudden this has come up and so strong armed.

    My partner and i are sick with worry now that we are going to have to give a defence as we dont know how this all works and most probably pay a 225 pound fine.

    Welcome to the forum - however please start your own thread to get help - this is an old thread you have latched onto.

    I note you have acknowledged service of the claim and trust you did this correctly to extend the time to submit the defence.

    Many CEL court claims do not have the full particulars of the claim and it states on the form that these will be sent separately and you cannot respond accurately until these arrive.

    Start doing some research on claims and read Pranksters Blogs and post on PPP for additional support - you may also wish to contact the BMPA.

    There is plenty of resources and assistance available.

    Start your own thread for more assistance and further advice.
