Virginmedia mobile misery

I have gone to the Ombudsman about Virginmobile. I stupidly switched from t-mobile because of the inclusive handset insurance included in smartphone contract but the contract doubled in length: from 12-24 months.
The handset I (again stupidly asked the sales staff instore what he recommended for my use) got never worked properly, I asked to exchange it to be informed that as 7 days had passed I could not.
Then the bills came in - being billed for texts that were meant to be unlimited (then told that I had to keep to under a certain number of digits or I would be charged), picturemessaging impossible to receive or send normally, voicemail not working (again another "free" feature but didn't work for months at a time). Because I kicked up a fuss I got the bills down to the £25 a month they were meant to be (an "offer for Virginmedia customers""), however handset issues continued. I asked to be released from the contract cos it was such a nightmare & was refused. I tolerated the handset (& had to go without things I had been used to such as multi-texts - hours spent to Customer services who assured me that the things that I was used to were not possible with a Windowsphone - ie I coudn't send photo texts or receive them to non-smart phone owners - always - turn on/off, remove battery etc. Thankfully someone introduced me to Whatsapp so I could send/receive photos within my internet part of my package - of course only to smartphone owners only) - it was faulty - now it no longer works at all. I have changed the charger & battery - 3 times. Eventually instore the staff took pity on my predicament & got someone sensible (I thought) on the phone at customer services.
Virginmedia have now offered me a £35 discount on a £70 excess because the phone is now over 1 year old...... I have told them I don't want the handset repaired because it was a basic model from the outset but also faulty from the outset, I need a new handset - I stated Samsung Galaxy 4 mini - it's android - a Windowsphone I was persuaded at sales wasn't a good idea - but for whose benefit exactly - certainly not mine?!. After a horrible conversation with a strident, patronising woman - specially selected from the Chief Execs office - I asked them to put their `offer' in writing. The offer ignores the faulty, missold Nokia Lumia 610 windowsphone issue completely - as far as I can see several points during the contract makes the contract void - saying that I can buy myself out of the remaining contract for £160....
CISAS - their Ombudsman wrote that they don't get involved until the dispute is 8 weeks old - I wrote back stating that the dispute is in fact 19 months old! Am waiting to hear back now

£160 buy yourself out or buy a solicitor or even CAB .
Your post is to much of a complaint to even try to work out the basic facts .0 -
