Parking Eye CCJ

I have just had a text message from Lloyds Bank and IDAWARE saying that I have had a CCJ added to my profile ... I rang them and they explained it was Parking Eye from July last year and I owe them £165.00 ... I have not received anything at my home address regarding this fine and the CCJ has been listed from Northampton court .....
Has anyone experienced the same and can they help please ASAP ...

This is not a fine! Nor was there any 'summons' as it's not a criminal matter either.

It's a small claim made by PE and yes they have tried small claims 8000 times or more last year and go to court every day now (defendable).

You contact the court to get it set aside as you had no paperwork about it. This costs a fee though unless the defendant is in receipt of high level benefits. Then the case can be re-scheduled for a hearing. If so you need to get up to speed with the current advice on the forum (sticky threads at the top, tells you about small claims court cases). Top of the forum.

This is an old thread and the current forum is literally ONE click away (see my signature). ALWAYS go to page one of any forum and read the sticky threads stuck as info notices at the top. Never land on an old forum thread and post on it - you were lucky this was even seen seeing as this is a 2010 archive thread!

Damn. Following advice at the beginning of this thread I ignored a parking eye ticket, some time ago it has to be said, and I've just received a summons for £165! I'm stuffed I assume?

Read back a couple of pages and I am NOT a ParkingEye plant, before anyone suggests otherwise :) Looks like I should be starting a new thread, so I'll do that. :(

Just to add the above poster was not stuffed:

and I think PE backed down when shown proof he was elsewhere in between 2 visits (I think his case is on the Parking Prankster's website as a case PE were forced to drop).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It costs about £80 though to set aside and does not automatically go away it will go to another hearing. So you need to be confident and start reading a lot of threads.

The other option is to simply pay the CCJ though to stop it appearing on your credit file - mark the payment under protest. This could be useful if you want to look at a counterclaim for damages against the landowner/parking eye especially if you happen to be covered say by the Equality Act or if it is on the list of recovery of parking charges service offered by Parking Prankster.

Check out his website in any case as the two guides there will be needed should this be set aside and go to another hearing.

No i wouldnt do this, you cant mark the payment under protest, although you can have a notice of correction added to your credit file, this is however next to useless .

There is no point paying it as it will simply stay on your credit file for 6 years. If you get it set aside you will then have it wiped around from your credit and then have the chance to defend the claim in full or settle which ever you choose to do

We don't know the date here though when received from the court - could be within the 28 days ...i.e. before appears on credit file.

The OP states that he has just received notification alert of the CCJ suggesting just occurred.

Paying under protest would be a viable alternative in this instance as taking a small claim would be cheaper than a set aside depending on circumstances and more details from OP

The OP advised they got a text from their credit file alert system which means its now on the credit file and thus after the 28 days

    So they did:o

Must pay more attention. In which case yes apply for the set aside without a shadow of a doubt which is the only viable option in this situation.

this is of course if the OP is genuine - any court losses today?
  • Well if they are genuine they take the advice ,:)

  • I'm interested to see if O.P actually comes back. Amazing how many times we see the thread title CCJ from ParkingEye (or variations) only for the poster to disappear. Hope I'm wrong.

I find it difficult to believe that someone who has been at the same address for over a year could get a CCJ and be unaware of it, This post smells of haddock in my opinion.
You never know how far you can go until you go too far.
