EE contract ended; still being charged

Hello everyone!

In December I got drunk at a Christmas Market (thank you mulled wine) and lost my BlackBerry on EE. My older brother gave me his old iPhone 4s and I got a new SIM card with Tesco. I rang EE and made them aware I would not be using the SIM card and to block the phone, as I lost the it and I have already sorted an alternative replacement.

Being so close to when I knew my BlackBerry contract expired, I didn't mind paying the rest of the contract until it was finished as my Tesco SIM is only £10 a month. My BlackBerry contract finished early March and to my surprise, I am still being charged.

I have rang up and they have said they need 30 days notice to cancel a contract, in which I will be subjected to ANOTHER monthly bill of £25. I find this particularly annoying seeing as I made them aware in December I don't even have the phone, nor did I ask for a replacement SIM. I signed a contract to say there are 24 contractual monthly payments; i'm tempted to cancel the standing order for next month as i'm currently unemployed and I could do with that money!!

Is it wise of me to cancel the SO or will that be more trouble than it's worth?

    Your contract didn't end with ee at the beginning of this month, you just reached the end of your minimum term. Check your contract, you signed a minimum term of 24 months, not a 24 month fixed term.
    It is absolutely not worth your while cancelling your dd, this would be credit rating suicide. EE would simply assign the debt to a collections agency and you'll have this hanging around your neck like a leper bell for the next 6 years.
    Make sure you now cancel the contract. You'll be liable for a 30 day notice as per the contract.
    £25 now is better than 6 years of credit hell.

    It seems you don't need to get drunk to make careless and expensive mistakes. The biggest of all would be cancelling the direct debit (it's NOT a standing order). It would be the third and most devasting error (the first being losing an expensive phone on contract and the second not giving proper formal notice to terminate the contract at the end of the term).

    Give the 30 days' notice and pay or face financial armageddon.

    To that I would add that you need to read the contract you signed. You did NOT have a 2 year contract - you had a 2 year minimum term.

    I know it's frustrating and you feel miffed, but do as mj says or you will get your credit record blackened.

    It still isn't giving the required 30 day notice though, is it?

    The OP intended to just allow the contract to run as he/she erroneously thought it was a fixed term that would automatically cancel, so there was no intent in their part for that conversation to be a termination request.

    It says that she won't be using the service not that she wants it cancelled.

    At best its ambiguously phrased.

    If EE had taken this as cancellation at that time, would you not think it strange that the OP did then not get a bill for the ETF, when their minimum term didn't end until March?

    I did tell them in December I no longer it, and the advisor told me to ring back in March and cancel! Never mind then, I will let them have their £25 and I think i'm done with phone contracts for a while!!
