problem with passcode

my ex had finally decided to give me back my iPhone 5 but has put some kind of code on it. I didn't have it long before he took so didn't really get around to knowing its features or how it worked and now I cant get pass this screen asking for pass code and obviously pointless asking ex about it as he know doubt did it deliberately so I couldn't use and now don't know what to do. can anyone help?

Do you have any receipt or order confirmation in your name with the phone IMEI number on it. Once you can prove it is your phone, Apple may swap it out but no promises that they will but worth a try.0

place the device in recovery mode and restore it to erase the device:- Disconnect the USB cable from the device, but leave the other end of the cable connected to your computer's USB port.
- Turn off the device: Press and hold the Sleep/Wake button for a few seconds until the red slider appears, then slide the slider. Wait for the device to shut down.
- While pressing and holding the Home button, reconnect the USB cable to the device. The device should turn on.
- Continue holding the Home button until you see the Connect to iTunes screen.
- iTunes will alert you that it has detected a device in recovery mode. Click OK, and then restore the device.

If it has the latest iOS, then after the wipe and restore it will ask for the Apple account and Password details of the person who's Apple ID was used on it last

Without that it's useless.
Apple may be able to help if you go in store with the right paperwork but thats the only hope..
And an hour after writing this theres a similar story on the BBC, Apple probably will not help you...
