Ebay damaged item return missing!

Had an issue where a n old manual typewriter was damaged in transit, asked the buyer to return for a refund and I'd make a damage claim.

Ebay case was opened, buyer advised they'd return via Hermes and a hold was put on the paypal payment.

Nothing from the buyer for over a week, including postal notification, and was going to chase this AM yet when I've logged into ebay the case has been updated, by the buyer, to advise me that

"Item delivered back to seller today and signed for"

It wasn't as I was at work, then out all day, from about 5.30 am till gone 5pm!

The only option is to send a refund, can't even send a message to the buyer, who to be honest was initially abusive and rude about having to return so can't see them being helpful!

Any ideas? Can't afford to simply write off the money without the item and can't find any help on ebay :(

    You don't have to refund unless the item has been returned, and there is proof of delivery.

    As jeffuk asks, what does the racking info say?

    No, Tracking hasn't been added to ebay. There is a section below the claim to show tracking and signature details but this is apparently "unavailable at this time".

    The only clue its apparently been sent, received and signed for is the buyers comment on the case.

    I have emailed them to ask for the tracking number but they were very evasive and slow to replyto the case before so my concern is they'll think I'm trying it on and start with the sweary and shouty emails again :(

    Don't refund until you have the item back.

    Update the case with "item has not been delivered and no tracking number has been supplied, as of (todays date)"

    If they start getting funny just get eBay to deal with the case.

    If there isn't proof that the item has been delivered to you (or delivery has been attempted), you won't have to refund.

    Send them another polite message via the resolution centre asking for the tracking number, as due to the fact it most definitely wasn't delivered / signed for, you think there may be some sort of mix up, and you are keen to get the matter resolved.

    If they get aggressive just ignore and let ebay assess the case.

    Had a reply from the buyer, apparently signed for and delivered at 13.24 - A surprise as I didn't get home till gone 6 last night!

    The tracking number generates the following for delivery notes :

    03/03/2014 13:24 Signature From Customer 03/03/2014 08:37 Courier Received 03/03/2014 05:04 Out For Delivery


    Along with the details of them sending, it doesn't show a signature or have a box for details (like Royal Mail) so doesn't help really - just the basic Hermes details

    I did specifically ask the buyer to return by a signed for service as other couriers will happily leave stuff outside my flat and wanted to avoid this.

    Now in a quandary - is this good enough for ebay to cough up the refund? Worried enough it'd be a squiggle signature that meant nothing but don't even have that! Surely they will require proof of delivery before releasing the refund?

    Sorry i must have misread your post because the way i read it , if attempted delivery was made they did not have to refund.
