  • The whole ESA..ATOS assesment thing is an utter mess..my partner is on ESA and he's had 3 assessments in 18 months..yet only once have we had a decision made..and that was after the last assessment where they said he was fit to work..yet no-one in the whole Employment/benefit system can advise him what type of job he could do with his disability. So he's appealing the decision and we've had the date for the appeal through for next month! He wants to be able to put his side across in court as he had the same experience as others...the questions asked in the ATOS assessment are generic..yeah he can lift his arm up..nod his head..sit down/stand up and walk across the room...yet he's only got 2 fingers on one hand that are movable...and he can't use them as he's got hyper-sensitivity..in other words even something as light as a feather touching his hand or arm is like he's got a million needles going into his skin at the same time...the ATOS form mentioned hardly anything my partner actually said in his assessment..more like they plucked things out of thin air to put on the form!!!
We've had our money dropped since he put in his appeal..i'm on his benefit as i'm unemployed and frantically looking for work as we don't like being on benefits and are made to feel like scum because we are.
Quick question relating to the appeal hearing...do you get the option to be represented in court or is it up to you to find representation?

No representation will be arranged for you.
This will not be paid for by legal aid.

Its not about what job he can do, its all down to wether he fits their criteria or not.

The pain in his hand sounds very like CRPS (RDS when I was diagnosed), whats he diagnosis?
