no air bag light found air bag fuse removed adivce please.

so i have just bought a new car well new for me.

did not notice when i tried it but there is no airbag warning light comming on at start up there is a space for it as in i can see the light but it does not come on and go off like other lights when you start the car up.

then i checked the internal fuse box. the cover is missing and so is the air bag fuse. grrr

i assume someone has removed the fuse to cover a fault light..

the car was only mot last this month am i right in thinking that

a) they shuld of checked that the light came on and then went off at when igition turned on as its now in the mot test ?

b) if they did not do this then they were neglegent ??

c) they removed fuse to get it to pass mot inwhich case they damn right neglegent ??

and d) it was sold as full moi have therefore i have some comeback with the garage were i bought ????as i dont think they did the mot uless they did the fuse pulling lol

anyway advice please before i phone them up tomorrow only got the car today its a 2004 kia carens btw.

also i assume the airbags are now currently not working in advent of an accident ???

They may simply claim the air bag warning lamp operated correctly when presented for test.
    Don’t be a can’t, be a can.
  • The garage are liable if you bought it recently.

The fuse is normally pulled to hide the fact the air bags are missing, ie been in a bump

No airbag light is not a good idea - but it is NOT a reason for failing an MOT.

At one time it was, but I believe it was removed from the list

Special Notice 01-2013” issued by VOSA to MOT test centres in March 2013

“Section 5.4, RFR 2 – SRS warning lamp inoperative has been deleted.”
  • was bought today,

no sure how they claim it worked correctly when no fuse so therefore it did not work at all unless it passed mot then the air bag system failed and the garage that sold it to me removed bulb so i would not notice.
  • Im pretty sure that if the airbag light is on its an MOT fail on the new Mot testing regs for this year/last year?.
  • me to so i assume that fuse was removed so it did not stay on, but surely it should of been noted that it did not do its check like the other safety systems were it comes on and goes off?

    You are absolutely correct.

But - if there is no lamp or the system has been rendered inoperative then the lamp cannot show a malfunction.

Makes a mockery of what was intended - but that's why they removed it from the list of reasons for rejection.

    Lamp on - fail.

    Missing lamp - pass.
  • so were do you think i stand on this?? should the car dealer have informed me of the problem? should they sort it ?

is it my fault for not noticing someone had disabled teh airbag system to get an mot pass?

i mean i would rather not die in a crash when the airbag doesnt deploy

    The dealer should fix it.

Tell them you are returning the car to be fixed so that the warning lights operate as KIA intended.

You must give them the opportunity to correct the fault.

If they can't - or won't - then reject the car, on safety grounds.

Do not accept it back if it is not correct.

If they prove awkward, see the CAB for advice as to how to reject the car and get a full refund.

I think the MOT issue is a red herring and probably won't help.

But to be certain visit an MOT tester and ask if your car will pass as it is.

    I think it would.

But I'll be happy to be proved wrong - for your sake.
