CC debt from 2003 is haunting me forever

    I'm going to start to tackle my other debt with barclays/apex. I'll be back with questions I am sure. Thanks again to those that are supportive!!!

    I'm sure BC or a Lowell will be in touch at some point.

    Clip clop, as the moral high horse rears its ugly head. I do love this place.

    Try and ignore all the arguing OP and do as advised regarding the CCA request. They won't have anything, or are unlikely to, and then you can decide how you want to play it. DCAs are scum bags, never forget that. So do not pay them anything without cast iron proof that you have to.

    I have received a letter form Bryan Carter regarding an outstanding balance for a CC and threatening CCJ action if I don’t pay in full by 7th May (tomorrow). The CC was taken out in 2003 the last payment made was Jan 2009. This CC debt has come from Halifax sold to Lowell passed to Fredrickson International and now to Bryan Carter.

    I had requested a CCA from Lowell when they sent me letters in August last year chasing the amount owed. They surprisingly provided me with one, they sent a copy of the signed application form (does this class as an agreement?) and a statement of all purchases and charges. From the statement they sent me the credit limit on the card was £550 all other charges are interest and late payment fees bringing the total balance to £1200.

    To delay the process slightly I have requested a CCA from Bryan Carter this was sent 27th April and I am yet to hear back from them.

    I have basically ignored Lowell from the point they sent across the CCA, I am a now looking into getting a mortgage over the next few months and this is the only default that is on my account.

    Now I am happy to pay the £550 CC limit amount but not willing to pay the interest and late payment fees. Could you please advise how best to word a letter or approach this and to have the default removed from my credit file?

    No. A statement and an application form is not a CCA. They know this and they are trying to blag it.

    Is the default date correct? If so, you won't get it removed.

    Just wait for the response to the latest CCA request then post back.

    If they threaten you before then, just tell them you are waiting a response to the latest CCA response as the last one Lowell tried to fob you off with is unenforceable and any court action will be defended on that basis.

    On further inspection it looks like both an agreement and application. Where i have signed it states this is a Credit Agreement Regulated by the Consumer Credit Act 1974.

    Would you class this as an agreement now?

    Also would you think they would be willing to settle a debt of £1200 for £500?
