Paypal's T&C don't override UK (EU) Law if the goods were brought on a ebay eu website ie ebay.co.uk.
Though how your going to claim I don't know.Do you want your money back, and a bit more, search for 'money claim online' - They don't like it up 'em Captain Mainwaring0 -

Unfortunately you will not get your return costs refunded and sending air sure or international signed for is going to cost you a pretty penny..maybe find out the return cost first. it maybe just be a purchase that will work out better filling in your experience cabinet.0

I have already been to the Royal Mail website to get an idea of how much it costs to post the item back via International Signed For. It will be £20. The full refund that I am looking for is £32. The return postage is more than a half of what I may get from the seller via PayPal.it maybe just be a purchase that will work out better filling in your experience cabinet.
It will be difficult for me to see it as a lesson to learn, simply because it is the seller who deliberately mis-sold me the item. On the advert the seller described the item as new and in original box. The seller also uploaded different photos to show the item and the outer box. But what I did not expect and realise is the seller cleverly cropped the photos so that none of the photos show the damaged area on the edge. And the outer box I received here is completely different to the one on photos.
I think when it comes to dealing with dishonest dodgy sellers, it will always be tricky no matter how experienced the buyer is.
Having said that, if there is a policy or rule saying the seller should be responsible for the return postage when the item is SNAD, I think it will stop all these non-sense on eBay. Sellers should only advertise items accurately. My seller should have never claimed the item was new when surely there is a damage on it. A seller like this should pay for the return postage plus a fine/penalty for deliberately telling lies. Thinking about it deeply, it is actually fraud.

The thing to file in your Experience Cabinet is ... don't buy from overseas. Or if you do then be aware of just this type of situation - is it really cheaper when you factor in end-to-end costs.
And just be thankful you weren't charged VAT and a handling charge for the import - that would really have rubbed salt in the wound.0 -

Could the damage not of occured during transit?
I thought about that too and that's what PayPal UK was suggesting, but the item itself was protected by the original polystyrene. Then the whole thing was wrapped in several layers of bubble wrap, and finally the item was placed inside a bigger carton box with more padding. I must say the item was well protected. This is why I believe the item has always been damaged before it was posted to me.0 -

The item is a limited edition (750 worldwide) with a unique item number. There is a chance he has/had more than one, but I doubt it is the case.If this was EBAY's policy there runs the danger of those suffering from buyers remorse could damage the item and file a SNAD.
But now buyers are suffering from sellers who deliberately sells SNAD items on eBay. The sellers also hope they can get away from it cos the buyers, like me, would not prepare to pay for return postage.0 -
Besides, even if the seller was based in the UK, it will still cost me £7 to post the item back within the UK by a trackable delivery.
The bottom line is, why should buyers need to pay for sellers' fault?
I genuinely just wanted to purchase this limited edition item, that's all, nothing more…
Going back to my initial question – what right I have got here in term of this return postage – does it mean I have to absorb the £20 return postage here, with no other option?0 -
Are you sure the item was sent damaged and was not damaged during transit?
You might not be aware but if it was shipped via the Global shipping prog then the items do get opened and checked just before being sent out of the USA. They get repackaged with the customs information.
I had an item that arrive damage, there was a slight hole in the packaging, I phoned ebay who put me through to ebay.com who in turn put me through to the global shipping prog department - who asked if the items packaging was damaged - The person who I spoke to arranged for a full refund for the full cost without needing to send the item back.
I know you have already opened a case within paypal - but I would try and speak to ebay.com to get them to transfer you to global shipping prog department (as far as I know is ebay UK cant transfer you but will transfer you to ebay.com)0
