    What's the location? Maybe streetview may help in seeing if there are any other restrictions.

    Also, how long was you parked there for and what was the contravention code?

  • They confirmed it was a doble yellow offence. There are no other restrictions here.
    The reason i thought it was ok is because round the corner u there is an area with dbl yellows all round it and u can park on the kerb and not get done.
    I asked why - because it's private land on the kerb.
    I didn't know so saw this, thought its off the "road" as such and thought I'd be ok.
    I wasnt loading etc, just a legit mistake.

    I did appeal saying this and had it rejected

    It was code 01 (double yellows) looking at the PCN on pepipoo where they have already pointed out the omission of the 3(2)(b) 'notwithstanding..' wording which Hippocrates linked for the OP to read that part of the regs.

    No it isn't private land - indeed it's part of the public highway! - and no they didn't say that on the rejection letter! You would be best paying £35 in time I think as (sorry but) it doesn't seem to me you have got your head around the contravention, let alone the technical wording omission you could further appeal on. Sometimes people should cut their losses if they haven't sussed out what pepipoo are suggesting - if you have understood the regs and the omission then go for it and get the 'Traffic Order' urgently from the Council, to check the double yellows should indeed be there at that place.

    the place round the corner is private land though, thats why i thought this was ok. Theres a sign on the fence saying private land... just a mistake, shoot me lol

    As is the case for 90% of the posters on pepipoo but many mange to win (most)! The link has been given to you by Hippocrates and as I said if you can't argue it face to face with an Adjudicator then pay £35 now. Just being realistic as you don't seem to get why you even got a ticket let alone the technical defence to argue.

    And yep, private land is not comparable to Public Highway!

    CM is not being rude; she is being pragmatic. She hardly ever advises people to pay, but she is right - you don't appear to understand the technical arguments necessary to have a fighting chance of getting this cancelled. If that really is the case, then you may wish to consider spending the £35 to put a stop to all this now.

    I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.
  • I would add that there is another difference in that £35 is a more legitimate sum than we see on private land, though you didn't realise at the time it seems to be a fair ticket, and to win this will take some hours of effort and you need to consider whether it is worth spending that amount of time for that amount of money.

    So to summarise, the ticket is likely to be legitimate though and there may be technicalities to defeat it it will require significant thought and effort to do so. It is doubtful as to whether it is worth your time to do so for £35. That's a couple of rounds of drinks.
