Tesco mobile selling opened boxes as new?

Hi I have been shopping around for a new mobile for a few weeks and finally settled on an HTC from Tesco mobile.

I went to our local store to organise the paper work (seemed an easy process as I was connecting it to an account one of my kids has). As we were leaving the store I noticed the the box was open and went back to the sales guy. He was fine accepted our issue canceled the paper work etc as he had no other phones.

Plan B was to order online because surely that wouldn't be opened going through the post or courier.

I have just received it today and noticed the same issue box opened no other packaging other than the bag the couriers use.

My wife called to find out what was going on (I was at work at this time)

According to the person she spoke with it is policy to open these devices and insert the sim before shipping.

To me this cant be right surly? Is it even legal to sell an opened box as "new" as there is no way to confirm it is not a return or even tampered with somewhere along the process.

  • I recall buying a phone from Tesco and it was opened in front of me at customer services to check that everything was there that should be there before I left the store.
    This guards the customer and the store in that you can see that all the bits are there in the box and it protects the store in case a dishonest customer goes back later to claim that something is missing.
  • See now to me that would make sense but this is not what happened.

    In store the once the paperwork was signed the box was just handed to us we were in the car when I spotted the tape was not sticky.

    But even at that opened before being shipped from the online store?
  • I think legally that the box does not need to be sealed to be classed as new as long as the goods inside are in fact new and not used. I think that it's likely that online suppliers might open the box before shipment to confirm that the contents are intact for the reasons given in my first post.

    However many suppliers do supply goods with the seal intact so it looks like it varies according to supplier.
