  • I've just been in contact with the store manager, he says i have valid reason for appeal, but its been too long for him to cancel. Told me to speak to Euro Car Parks directly, but if i do that will i then be admitting being the driver? if the refuse to cancel it im in the shi*e co ive admitted being the driver

    You need to slow down and listen to what you are being told (even if some of the advice you are getting is being offered somewhat less than graciously).

    Would it help you to calm down if you knew that, in the year to the end of last September, ECP issued 93,000 fake parking tickets but just TWO court claims?

    No you don't admit to being the driver, you wait for the Notice to Keeper to arrive in each case, then you appeal using a template like this, the appeal will be from the registered keeper not the driver.
    Dear Ticketers

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as is my right under the Protection of Freedoms Act 2012, all liability to you company is denied on the following:

    1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
    2) Your signage does not comply with the BPA Code of Practice
    3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass

    These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.

    If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Please issue your cancellation within 35 days of this letter or a popla verification code. I have nothing further to add.

    Probably issued more than that because those are just the EDI requests, how many appeals would have been done from the notice to driver?

    I have read all the stickys and info you have kindly given (maybe on more than one ocassion) i am currently writing the template or the 2 notices i received.

    Once the manager at Morrisons told be to call Euro Car Parks as they might cancel it, i did think to myself it might be a bad idea, which i why i posted on here just incase.

    And yes Bazster it does make me feel better knowing ECP issued 93,000 fake parking tickets but just TWO court claims!

    I shall send the 2 letter off, and keep you informed of its progress

    It's difficult to be gracious when you've already helped and directed the poster in their first thread In January, to the NEWBIES thread - and there's only one appeal template on there now. One spoon-fed pre-written template letter, confusing? To someone for whom English isn't their first language, yes, but that's all.

    "Aggressive" seems to be the default tone towards new posters here now. No consideration for the fact that many of the new posters are new to any internet forum at all, let alone this one. Add to that the persistent failure to give people the true facts about the likelihood (or otherwise) of any particular PPC taking any real action against them, and one might be led to conclude that the aim here is to browbeat people to follow a certain party line instead of giving them the tools to make their own decisions. Even the constant references to "NEWBIES" are condescending and belittling.

    People should perhaps remember that this is MSE's forum, not yours, it's open to anyone who obeys the house rules, and it's not the private fiefdom of any particular party or pressure group (except perhaps Martin Lewis). People who want to hear just one opinion, want to promote just one opinion, want to bully "newbies" into believing their one opinion, and want to suppress any opinion but their one opinion, should perhaps toddle off and set up their own forum somewhere else where they can be as tyrannical as they wish.

    You use the word 'opinion' in your latter para, but it is the wrong word.
    The posts on these Threads deal with PPC FACT, unlike your post.
    Much time and research is freely, generously, repeatedly given by people who know their stuff here. Their hard work does not merit your pulpit stance.

    Your name does not feature as one of the Knights or Ladies that I come across when following these parking Threads, as I do closely.
