Trying to sell house that ex lives in

I've let my ex live in my old house for a while now (I've moved out, it was a messy break up) but now its time to move on. The house is up for sale and I've let her take charge of viewings/liasing with agents mainly because there's no money in the house so I've no interest in it and i trusted her to take care of it. I've tried to play ball but the house isn't selling and 3 buyers have pulled out so far, I'm worried now that if i start to dig my heels in and take charge of the sale that she'll take me to court and claim rights to the house because she's lived there alone and paid the mortgage alone, even though its all solely in my name. I'm petrified i dont have a leg to stand on here, all because I've tried to be civil and keep her happy. Does she have rights to stay against my will? She cant buy the house herself as she doesn't earn enough.

What are you worried about? If their is no money in the house what is their to claim right to?

Doesn't make sense why she'd spend money to try and 'get the house' when theirs nothing to gain.People don't know what they want until you show them.0 -
Do you have children with her? Are they living with her in your house?0

You won't want to hear it, but the best thing you could do is move back in!
Really a case of shutting the gate after the horse has bolted. Why did you move out if the property's in your name?! As above - if you have children together, that's a different ball game.
(If something is messy, clean it up there and then. Leaving it will only make things worse!

PS are you sure she's been paying the mortgage?! Why did you stop paying? That's one hell of a gamble, letting an ex stay in your (presumably) house and paying your mortgage! Does the mortgage provider know? Is her name on the deeds or was it solely yours?

Wouldn't she be classed as a tenant by now? Landlords have to give proper notice when they want tenants to move out.

Good point - and I expect you'd be right. The OP should have been accepting any payment as 'rent' and not saying she's paying the mortgage - that really should have been coming from his A/C still! Maybe the OP can clarify if that is the case. Does the mortgage payment go straight from her a/c to whoever?

Sorry to clarify, no kids and never married, yes she pays from her account as it just seemed easier than her giving me cash every month. In hindsight i haven't been very smart, but just wanted to know what her rights are to staying put in the house if it got nasty. There is about £2k/£3k to be made from the house which I've said she can take to put a deposit on a rented flat etc. i just want rid now. I cant move in as i have a new partner now.0

And yes I've always checked with the mortgage people and payments have always been made on time.0

Have you considered the possibility that she isn't bothered about selling up and is disinclined to do anything positive to facilitate the sale of the house?Overactively underachieving for almost half a century0
