Right To Buy Scheme - Questions

Hi there,

I'm looking to purchase my council house using the right to buy scheme and one of the rules is that you must have been a council tenant for at least 5 years to qualify.

My question is does being a council tenant mean the number of years living in the council property or the number of years actually paying rent, as the answer would be significantly different, depending on what the criteria is for being a council tenant.

Apologies in advance if this is a stupid question.

    Sorry, but just to be clear when you say number of year with a public sector landlord, do you mean number years living within a public section landlord property?

    NHS Trust , HA or Council as your landlord for 5 plus years , irrespective of which house (as far as i know)

    I'm not sure you are understanding what my question is:

    Its specifically what to do with the definition of a 'council tenant'

    Is it

    1) Number of years living within the property (even if not paying rent)?
    2) Number of years paying rent to the council?
    3) Number of years living within the property after the age of 18?

    Hope that clears up any confusion.

  • The original question was quite clear.

    You have to be a current tenant and have been paying rent to your current local authority (or transferred from another LA or accredited housing association as a paying tenant) for the past 5 years.

    there is an eligibility checker questions and answers on the governments right to buy website,
    http://righttobuy.communities.gov.uk

    if you are not a council tenant then you would not be named on the tenancy agreement and so you would not be an eligible council tenant would you! Tenants are the ones who are responsible for paying the rent so it goes without saying that it is number 2 on your list

    I assume from your question that this is a house you grew up in but it is less than 5 years since you were named on the tenancy agreement in your own right as until then it was only in your parents name because you are less than 23 years old or your parents did not (in simple terms) put you on the tenancy until less than 5 years ago even though you have been living there longer than that ? In either case you would have less than 5 years as a tenant so you don't qualify

    How was it vague ? , the answer i gave was absolutley spot on?
