Excel Parking ticket sold to rossendale collect

Hi

i received in january a letter from rossendales collect demanding £136 for a parking ticket from excel parking that i never received, i rang they told me to ring excel which i did who told me to sent the appeal by email which i also did sending copies to rossendales, watchdog and popla, all i got back was automated messages.

Last week i got another letter from rossendales saying because i had not been in contact they would be taking the matter to court, i again rang excel, popla and rossendales. I have had no response by letter or email and have told them that the do not intimidate me as they have both broken the code of practice.

Are they likely to take it to court? Or should i dig deep and just ignore them or reply by email so i have proof i have replied to their correspondence have sent 15 emails already?

    Why do you keep ringing this bunch? No-one here rings Rossendales nor Excel - apart from anything else, you have no paper trail of what was said AND you are not ringing up fair/normal firms you know, so it's pointless. These are companies which want your money...and secondly...they want your money. END OF THEIR AGENDA.

    Please do read the 'NEWBIES read this first' sticky thread as post #4 in it is all about your options at debt collector stage and post #6 gives you the BPA and DVLA email addies if you want to complain about no Notice being sent by Excel. Also you may want to consider naming the driver as an option to reset the clock to appeal stage (only of an ANPR ticket was alleged, such as at the tedious old Peel Centre).

    All covered in the stickies I think.

  • When I read this OP's title - I thought that the debt had actually been BOUGHT - but that is clearly not the case after all. Telephoning is a waste of time as CM states and ringing POPLA????? (where did that come from?)

    Excel are starting to increase court cases - so definite complaints to BPA and DVLA stating no PCN sent.

    Perhaps a cease and desist letter to Rossendales referring matter back to client too.

    But what you should be doing is complaining to the retailer - is this the Peel Centre?

    Yes, ignore it or

    1 - if a postal PCN at first, then consider naming the driver to reset the clock. BUT NOT if it was a windscreen ticket.

    2 - you could send Excel a postal letter (NOT EMAIL FOR A FORMAL RESPONSE) setting out your case as keeper (not driver) as to why they have no cause to pursue you. Which would be all the usual POPLA appeal stuff and the fact you have NEVER received a NTK. Don't get carried away and imply who was driving...

    All explained in the NEWBIEs sticky I think. Your choice how you play it for now. Obviously don't ignore a Letter before Claim from Excel, or court papers.

    but its NOT a Letter before claim , mainly a "Fishing" letter

    either way it is debt collection letters causing it and they have up to 6 years to pursue this alleged debt under the small claims court service

    the forum advice is ignore the debt collectors

    the forum advice for 10 years or so has been "ignore the debt collectors"

    as for the worry, anyone who gets the letters is worried, nothing we can do about that , blame the debt collectors, not us

    maybe the best bet is not to open or read the debt collector letters, just file them

    if you get an LBC or MCOL, then come back and get help, but nobody can help you whilst the debt collectors have their teeth into you , unless you claim harassment and report them to the police like it says here https://forums.moneysavingexpert.com/discussion/5035872

    otherwise there is no "magic wand" to be rid of them

    my advice was friendly , its a letter you can ignore quite safely and stop worring

    come back and start a new thread if you get a Letter before Court action

    unfortunately, the advice is already in the NEWBIES sticky thread and as I said there is no "get out of jail free card" so you will have to weather the storm for 6 long years from the contravention date , unless the creditor or landowner seek recompense (the LBC or the MCOL)
