Contract Phone Which Is Faulty

My son is on 02 and his phone has broken so now he has to pay when he doesn't have a phone. He has had it for 13 months. Do contract Mobiles come under the sales of good act?

phone and contract are seperate, phone is subject to SOGA as much as any other appliance. Depends why its broken ? water damaged or just died ??

can you find many reports of the same fault if you search on google ?

To emphasise: Your contract is for the provision of a mobile service. A broken phone doesn't remove your obligation to pay the contractual amount.

What brand? Some mobiles have a 24m warranty, so check that first and if still in warranty get it fixed by the manufacturer.
