Thanks for getting back to me InsideInsurance.
For sure, I understand that the mistake is in my court, it is a hard one to swallow, as apart from a sale that the shop wasn't getting if we had walked past, actually refunding us isn't costing them anything.
I think that I might take a visit this afternoon and make a plea to his moral compass or otherwise get it sized up and order the new one.
I guess you can't protect idiots from themselves all the time.0 -

It does cost them, for the sales guy he doesnt get his commission and for the company it means they now have another piece of unsold stock. Even a credit note leaves a liability on their P&L0 -
For sure, I guess that thinking about it I see that as the case.
Only now that I have it home and have seen the model number on the inside and his saying that it was a bespoke, very different ring, I find that it's on sites online and his mark up is about £600.
Maybe a credit note is the way to go, can you sell it on to a third party or do I have to use it?0 -
Bespoke means made to the customers specification, so did you design the ring?
"Very different" on the other hand is much more subjective. You could take a stock 4 claw setting with two baguette side stones and set it with a 2ct yellow marquise diamond and would certainly end up with something that is very uncommon/ different even if the basic mount is sold in hundreds of shops.
£600 markup isnt necessarily very much at all, depending on the price of the item. If you compare what high street jewelers sell engagement rings for against what you can buy from say Blue Nile (even before cashback) and you are often looking at close to a 100% markup. I know one on here once was ~£2,750 but the poster had paid over £6,000 in Beaverbrooks.
You'd need to check the terms on the credit note as to if they are transferable or not. They are not a regulated thing so the merchant can apply whatever terms they want to them.0 -
OK guys we are back from the shop.
Firstly, thanks for the time you have taken in replying and all the advice.
We were with the owner for a couple of hours and it was all haggling and compromising.
In the end I choose another ring for £350 less than the original price and he let my g/f pick some earrings, necklace and bangle with the credit. It leaves us with the grand sum of £25 to pick some other trinket out with in the next three months.
The bitter taste hasn't stained the new ring and everyone is smiling!!!!0
