Buyer changed her mind. Should I return her deposit?

    So, she has offered £50, 10% of the asking price for her mistake?

    Sounds good to me.

    But from your point of view she has backed out, agreed.

    But what has it cost you?

    The real solution is to ensure you don't rob her, and she pays you for all loses. If you have a genuine case to argue then fine, but £50 for an advert seems a good return to me

    cyclonebri1 But, if the OP does need to dispose of the conservatory in a skip because of constraints of time, that'd cost her £200 for a decent-sized skip. That's not a grabbing punter. She may find another buyer in the time - in which case there's a strong case for deducting reasonable costs from the deposit, and returning the rest - especially if it sells for more than the £500. However, there's no way I would personally risk having to pay the £200 for a skip, purely because of the dilly-dallying of the deposit-payer.

    I think the OP should consider if the boot was on the other foot, would she expect her all or just some of her deposit back ? However as has been said , fraud could be a consideration here as its on that well known site, so i suggest caution!

    The question becomes, what would have happened if the buyer had never contacted the OP in the first place? That is the position that the OP has the right to be in now.

    So, for example...

    Scenario 1.
    OP places advert.
    Buyer contacts OP offering to pay full price and pays a £250 deposit.
    Second buyer contacts OP and offers to pay full price, but OP says it's already sold.
    Second buyer buys a different conservatory.
    Buyer pulls out.
    OP has no time to sell conservatory and pays £200 to have it removed.

    In this scenario, if the buyer hadn't been involved then the OP would have sold to the second buyer and would have £500 and the conservatory.
    But the buyers actions mean that he's, in effect, only got £50 for the conservatory. Not only should he not return the deposit but the buyer should pay a further £450.


    Scenario 2.
    OP places advert.
    Buyer contacts OP offering to pay full price and pays a £250 deposit.
    Advert remains live but no further buyers are interested.
    Buyer pulls out.
    OP has no time to sell conservatory and pays £200 to have it removed.

    In this scenario, if the buyer hadn't been involved then the OP would have been in the same situation that they are in now. If no-one else was interested and the advert stayed live then the OP wouldn't have sold it to anyone else.
    In which case the OP should refund the deposit. (*)


    In reality it is likely to be something between the two scenarios, but without knowing what else happened it is impossible to call.


    (*) Though I would be very wary of refunding due to the possibility of fraud.

    Keep it. Tell her tough...If she's from elsewhere I doubt she knows your address?
  • If the boot was on the other foot. I would never have agreed to purchase something until I had the necessary permission from the council.
    We had agreed a sale. It was not subject to planning permission. I think it might be an excuse to back out.

    Since the £250 was paid over 5 weeks ago I don't think it's a scam.

    I will send her a text to tell her I will not be returning anything until after I have disposed of the conservatory and if I do sell it for £500 I'll be happy to refund her in full.
