Hit by possibly uninsured driver,, police not interested

Couple of weeks ago my parked car was hit by another car, driver did not stop

Was witnessed by 3 other people who agreed in reg of card and provide me with details

Phones aviva, my insurers, couldn't find his car on their database as having insurance and I couldn't on the askmid site

Reported to police same night of accident, they took details, located the car in their system but wouldn't investigate until I took my details to the station, did that the next day. Police officer clearly not fussed or interested

Since then, I have found the drivers, name, address, phone number, have photos of the damage to his car which would be consistent with the eye witness statements. Have provided these to aviva who keep asking me to contact the driver to get a policy number, he told me he is insured with "melton farmers" but doesn't have his insurance details to hand! (I wonder of he meant nfu?), now I don't think I'm being unreasonable in expecting aviva to follow his up and chase his details etc

The police have still not been to him or phoned and as far as they are concerned they have said he has no legal obligation to provide his insurance details to me or my insurers as it was a damage only accident. Now that doesn't sound right to me but they clearly have no interest in following up a failing to stop and possibly uninsured driver.

My car is being fixed in my policy currently and aviva do have an unisured driver promise so I will get my excess back eventually but this could be some time the speed they are going.

Any thoughts on what I can get the police to do? Sorry should probably be on the rant board but can't quite believe that neither the insurers or police can't be bothered to deal with this

    It sounds like they have seen the driver is insured.

    Have you tried ask mid to see if the vehicle is insured?

  • From my experience Aviva work in slow motion. My wife was hit by an elderly gent who was driving on the wrong side of the road. There were several witnesses and photographs of the incident and road layout were provided. The guy admitted it was his fault.

    Both parties were insured with Aviva and it took months of chasing for them to finally sort it out. At one point they even proposed a 50/50 liability despite the other guy admitting it was his fault and the witness statements all confirming this.

    My wife contacted the witnesses who all provided their statements within a week of the accident.

    Aviva really were a joke so be prepared to do a lot of chasing to keep them interested or nothing will happen for a very long time.

    The OP said they had already checked MID

    Police are always very hit and miss on what they will and wont do with relatively minor incidents.

    Police are always very hit and miss on what they will and wont do with relatively minor incidents.

    It dos seem that way, I would have thought they would be more proactive in getting potentially uninsured drivers off the road, they know where he lives, it seems a quick win for them, let's hope the next time it's not a child he hits!

    Aviva still tell me they can't see any insurance for the car, nor can the police (or they couldn't when I reported it)
    Have checked the ask mid and no insurance shown for the reg/car

    Similar thing with tax discs, when I first started driving and they used to do the occasional drink driving stops etc then they always used to physically check the tax disc. Now they dont even glance at it as again its all done automatically even though technically the offence is not displaying a valid disc rather than simply not having one and whilst the system can tell if you've bought one or not it clearly cannot test if your displaying it

    Actually,that's a fair point and one I hadn't thought about. Maybe he's already been fined for not having insurance as an automatic thing, do you know what the computer does if they remain uninsured...do they just keep getting fined, is it forgotten about or at some point does the computer spit out a command for a person to do something?

    No idea and it is a separate lower offence to driving without insurance. In theory the police should be interested but there are many variables in these things.

    Had a bag stolen from under a table in a restaurant and was told it was "lost property" because I didnt see anyone take it. My car was hit in the station carpark 2 weeks ago and the Transport Police have been very efficient, got the CCTV, sent me copies of it, inspected the vehicle etc.

    As you are costing Aviva some money one would like to hope (for the sake of their other policyholders and shareholders) they will be chasing this up with the third party instead of continually asking you to do their job for them!


    Does their uninsured driver promise include no loss of NCD?


    If not then if this is concluded by them as an uninsured driver episode, you may want to consider pursuing the third party yourself for your uninsured losses - assuming you think he has the funds to pay up of course.
