I too, would have thought they'd be a little more keen to pursue their losses. I am done with chasing them up and doing what I perceive to be their job. But I won't be waiting forever to get my excess back ;-)0 -

you might get your excess & NCB back but that's a marketing exercise and you will still end up with a fault claim on your record together with the associated future premium loadings.
As you have identified car & driver then the alternative thing to do would have been to claim against the MIB uninsured driver scheme0 -

That would be unusual as their promise is simply that your no claims bonus won't be affected with a possibility of recovering your excess.
It makes no mention of noting the claim as a non fault claim and that would mess up the accuracy of the data on the C.U.E database0 -
Have just checked documents and you are correct, which is not what I was led to believe. So even if the uninsured driver admits liability it will still be recorded as a fault claim?
Presumably given aviva know the details of the driver and there are 3 witnesses, and the driver had admitted liability, they will chase this up to recover costs directly from the uninsured driver, on recovery would they then place this as a no fault claim? If they don't bother chasing this up would my uninsured loss cover be able to tackle this although I accept it's hard to quantify a cost to this0 -
Yes its a fault claim unless they get full recovery of all their outlay.
("Fault" doesn't mean "blame" in insurance language).
If the third party is uninsured but has assets hopefully Aviva will pursue him!
Equally you would need to be sure the third party has the funds to pay you if you pursue him for your uninsured losses.0 -
Well, there's always his car as an asset, would be worth pursing it just to send it for scrap ;-)0

It's really a moot point now, but are the police correct in saying that someone does not need to give you any insurance details at all unless there is an injury?0
