Help please.
My 83 year old father has recently received a £100 PCN from ParkingEye because he parked in the Royal Free Hospital in a disabled bay with his blue badge displayed correctly. What he didn't know is that now you are required to take your badge to recption. This is stated on the signage but why would he look at that when he has a badge and dosen't have to pay to park. Anyway, my question is, he is now an inpatient at the hospital and will be for some time.
I have appealed to the hospital on his behalf but they have not replied. Can I appeal on his behalf or is it only the registered keeper that can? We haven't told him about the PCN yet as he has enough to worry about. As I type this he is in the operating theatre while they try to save his legs.
I also am in receipt of a £100 PCN as I followed the ambulance to A&E and used his badge to park outside the hospital enterance in the hope he would be allowed home and was also unaware of the changes to the parking policy. I shall appeal my charge following the excellent advice in this forum.

This is what ParkingEye do - prey on the vulnerable and disabled. This is despite the BPA Code of Practice explicitly stating that tickets should not be issued to blue badge holders. They are an utter disgrace.
The good news is that you will beat these charges but you might have a little bit of work to do - you seem to be pretty clued up so far.
I'm sure Coupon-mad will be along soon enough to deal with the Equality Act breaches involved here (by PE and the hospital, not you) but the most glaring one is the extra condition imposed in respect of producing blue badges to reception.
In your shoes I would be also be putting in an appeal to PE on behalf of your hospitalised father - if they refused to acknowledge it then I'd raise merry hell with all concerned.
In any case you need to be complaining in the strongest possible terms to
1. PALS - tell them how disgusted you are and if these charges are not cancelled immediately you will be contacting the local press etc etc
2. The BPA for the CoP breach
3. The DVLA because the CoP breach means that PE have also breached their contract with them (search for KADOE on this forum and you'll see what I mean)0 -

the RK has to appeal but you can do all the paperwork etc and then it can be sent off as if he did it , so you do the legwork, but he actually appeals
The EA 2010 applies even if the BB didnt , (the BB isnt relevant on private land)0 -

Read the Sticky at the top of the thread anyway in case you don't get the fake charges cancelled by the hospital.
Do not pay, do not ignore, do not under any circumstances reveal who was driving on either occassion no matter what you may be told by parking lie. Come back here for further advice but please ensure you do not miss the appeals deadlines if the charges aren't cancelled.I married my cousin. I had to...I don't have a sister.

I have until the 25th Feb and 2nd March to appeal by so I can wait a few days to maybe hear from the hospital. Have read the sticky and am confident can beat these b******s with the forums help. Will post my appeal on here for your perusal before sending if that's alright. Thanks again.0

Some good news today. The hospital have agreed to cancel my fathers parking charge but not mine as he was taken by ambulance.
So one down, one to go. I shall now start composing my appeal to ParkingEye which will of course be rejected.0 -

That's good news, plus very good news about his successful leg op as well. However, you need written confirmation from the hospital that they have cancelled the charge otherwise parking lie will still come after him.
Don't leave things so late that you miss his deadline date for an appeal if the hospital haven't come up with the goods in time.
As for your appeal, you still need to hit the hospital hard as you were waiting to collect you disabled Dad so you had every right to use his badge. The fact that you couldn't collect him was not known at the time and you parked using his badge in good faith. In any case, the BB has no standing on private property but you should still complain to the hospital that they (the hospital) have committed a breach of the 2010 Equality Act.I married my cousin. I am struggling to work out how an NHS car park can be "private land". There are signs all over my local hospital saying that it belongs to me.You never know how far you can go until you go too far.0

Firstly, I’d like to confirm that we will be able to cancel this PCN for you. Please be reassured that I have arranged cancellation of this PCN and that you will receive confirmation through the post direct from Parking Eye to confirm this, usually within 21 days.
So it looks like I have the first one covered.
Excerpts from the second e-mail
I have reviewed your appeal and find that the PCN was issued correctly. I made this decision based on the information provided in your email which demonstrates that the blue badge holder was not being conveyed in the vehicle to the hospital and as such the blue badge was not valid for use. I note that I have cancelled a previous PCN relating to use of this blue badge which was used correctly at the time and by way of a reminder to avoid any further PCN’s being issued in future please ensure that the blue badge holder register at security or main reception for 4 hours free parking or that you pay the appropriate fee for parking as required.
Do you think I should now forget about the hospital and go straight to the appeals to ParkingEye and POPLA or submit a further appeal to the hospital. Fruitcake mentions a breach of the 2010 Equality Act but I have no understanding of the act. What was the breach? Any thoughts would be greatly appreciated.
